C) City of Santa Ana <br />the CAP, thereby agreeing to the corrective action set forth in the CAP, with <br />any areas of disagreement noted in writing. A copy of the signed CAP shall be <br />furnished to Contractor at the conclusion of the CAP meeting. <br />ii.Correction Period <br />Correction of the service or performance deficiency, or substantial inadequacy, <br />shall occur within a period of not to exceed sixty (60) days from the <br />development of the CAP, unless the OCFA representative determines that <br />correction cannot be accomplished within the specified time frame. When <br />correction will take longer than sixty (60) days from the development of the <br />CAP, the CAP shall specify interim dates by which specific steps toward <br />correction of the service or performance deficiency, or substantial inadequacy, <br />will take place with the total time period not to exceed three (3) months. <br />iii.CAP Inspection/Compliance <br />The Fire Chief or his designee, shall visit and inspect Contractor's business <br />office, facilities, vehicles, personnel, and/or records to review and document <br />actions taken by Contractor to implement the CAP and shall document any <br />continuing service or performance deficiency, or substantial inadequacy, which <br />is not corrected within the specified time frame. In the event Contractor fails to <br />correct the service or performance deficiency, or substantial inadequacy <br />identified in the CAP within the time frame provided, OCFA may find <br />Contractor to be in material breach of the Agreement. <br />D. Timely Performance Required <br />Assessment of penalties or the imposition of a CAP, pursuant to this Section will not <br />relieve Contractor of the responsibility to meet all performance expectations as set forth <br />in the Contract Documents. Substandard cumulative response time performance (i.e., <br />below the 90% compliance rate for combined Code 2 and Code 3 calls) in any two (2) <br />quarters in a single twelve (12) month period will constitute breach of contract, resulting <br />in the imposition of a Remedial Action Plan (RAP). <br />Phase 2 RFP: Emergency Ambulance Transportation and Related Services Page 1 39 <br />June 14, 2012 <br />25F-58
