INSURANCE NOT ON BILE A-2012-195 <br />WORK MAY PHOCEED <br />AGREEMENT FOR PROVISION OF REAL ESTATE SERVICES <br />!U' THIS AGREEMENT, made and entered into this 20th day of August, 2012 by and <br />\ (? between FIRETEC Used Apparatus Sales, a general partnership (hereinafter "Broker"), and the <br />City of Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California (hereinafter "City"). <br />RECITALS <br />v? A. The City desires to retain a consultant having special skill and knowledge in the field of <br /> fire equipment brokerage to provide listing and marketing services for surplus fire <br />?v apparatus owned by City. <br /> B. Broker represents that Broker is able and willing to provide such services to the City. <br />f? C. In undertaking the performance of this Agreement, Broker represents that it is <br /> knowledgeable in its field and that any services performed by Broker under this <br /> Agreement will be performed in compliance with such standards as may reasonably be <br /> expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />SCOPE OF SERVICES <br />Broker shall promote, advertise and complete the sale documents necessary to sell the <br />inventory of surplus fire equipment owned by the City of Santa Ana, as set forth in Broker's <br />Proposal, attached hereto as Exhibit A, and incorporated by reference. City <br />retains the right to transfer ownership to any entity based on City's surplus policy, of any fire
