Box 1988 (M- 30) <br />Santa Ana, California 92702 <br />Space Above This Line for Recorder's Office <br />NO FEE: GOVERNMENT CODE <br />SECTION 6103 <br />JOINT USE AGREEMENT AND COVENANT BY AND BETWEEN <br />SANTA ANA UNIFIED SCHOOL DISTRICT AND THE CITY OF SANTA ANA <br />THIS Joint Use Covenant and Agreement ("AGREEMENT") is dated as of June 3, 2002, by and <br />between the Santa Ana Unified School District ("District"), a public school district duly organized <br />and existing under the laws of the state of California, and the City of Santa Ana ("City"), a charter <br />city and municipal corporation duly organized and existing under the constitution and laws of the <br />state of California. <br />RECITALS: <br />WHEREAS, the City owns and operates Centennial Park with the City of Santa Ana, depicted on <br />the map attached hereto as Exhibit "A"; and, <br />WHEREAS, the City acquired Centennial Park from the U.S. Government subject to the <br />condition that it forever be dedicated and set aside for recreational purposes; and <br />WHEREAS, District has sought City's agreement to convey approximately 18.84 acres of <br />Centennial Park to the District for use as a site for a performing arts center and athletic facilities <br />(hereinafter defined as the Joint Use Property) to support Hector Godinez Fundamental High <br />School being developed at Centennial Park; and, <br />WHEREAS, concurrent with approval of this Agreement, the City has agreed to convey the Joint <br />Use Property in consideration for this covenant to make use of the High School facilities, <br />primarily those on the parkland, for community and City purposes so as to maximize the <br />beneficial use of the land and facilities for the entire community. <br />NOW, THEREFORE, for and in consideration of the mutual promises and agreements contained <br />herein, the parties hereto agree as follows: <br />C'-
