iv. "Subrecipient" means an entity that receives a subaward from you <br />under this award; and is accountable to you for the use of the federal funds <br />provided by the subaward. <br />44. Will comply, as applicable, with the provisions of the Davis-Bacon Act (40 U.S.C. <br />Section 276a to 276a-7), the Copeland Act (40 U.S.C. Section 276c and 18 U.S.C. Sections <br />874), and the Contract Work Hours and Safety Standards Act (40 U.S.C. Sections 327- <br />333), regarding labor standards for federally-assisted construction sub-agreements. <br />45. Agrees that: <br />a. No federal appropriated funds have been paid or will be paid, by or on behalf of <br />the undersigned, to any person for influencing or attempting to influence an officer <br />or employee of any agency, a Member of Congress, an officer or employee of <br />Congress, or an employee of a Member of Congress in connection with the making <br />of any federal grant, the entering into of any cooperative agreement, and the <br />extension, continuation, renewal, amendment, or modification of any federal grant <br />or cooperative agreement. <br />b. If any other funds than federal appropriated funds have been paid or will be paid <br />to any person for influencing or attempting to influence an officer or employee of <br />any agency, a Member of Congress, an officer or an employee of Congress, or <br />employee of a Member of Congress in connection with the federal grant or <br />cooperative agreement, the undersigned shall complete and submit Standard Form <br />LLL, "Disclosure of Lobbying Activities," in accordance with its instructions. <br />c. The undersigned shall require that the language of this certification be included <br />in the award documents for all sub awards at all tiers including subgrants, contracts <br />under grants and cooperative agreements, and subcontract(s) and that all sub <br />recipients shall certify and disclose accordingly. <br />d. This certification is a material representation of fact upon which reliance was <br />placed when this transaction was made or entered into. Submission of this <br />certification is a prerequisite for making or entering into this transaction imposed <br />by section 1352, Title 31, U.S. Code. Any person who fails to file the required <br />certification shall be subject to a civil penalty of not less than $10,000 and not <br />more than $100,000 for each such failure. <br />46. Agrees that equipment acquired or obtained with grant funds: <br />a. Will be made available pursuant to applicable terms of the California Disaster <br />and Civil Defense Master Mutual Aid Agreement in consultation with <br />representatives of the various fire, emergency medical, hazardous materials <br />response services, and law enforcement agencies within the jurisdiction of the <br />applicant, and deployed with personnel trained in the use of such equipment in a <br />manner consistent with the California Law Enforcement Mutual Aid Plan or the <br />California Fire Services and Rescue Mutual Aid Plan. <br />b. Is consistent with needs as identified in the State Homeland Security Strategy <br />and will be deployed in conformance with that Strategy. <br />47. Agrees that funds awarded under this grant will be used to supplement existing funds <br />for program activities, and will not supplant (replace) non-federal funds. <br />48. Will comply with all applicable federal statutes, regulations, policies, guidelines and <br />requirements, including OMB Circulars A102 and A-133, E.O. 12372 and the current <br />Administrative Requirements, Cost Principles, and Audit Requirements. <br />49. Will comply with all provisions of 2 CFR, including: Part 215 Uniform Administrative <br />Requirements for Grants and Agreements with Institutions of Higher Education, Hospitals, <br />and Other Non-Profit Organizations (OMB Circular A-110); Part 225 Cost Principles for <br />36
