ADDENDUM NO. I <br />REQUEST FOR BIDS FOR PROVIDING LANDSCAPE <br />AND GROUNDS MAINTENANCE AT SANTA ANA ZOO <br />Reference Santa Ana Zoo Landscape & Grounds Maintenance Specifications 8-05-08 <br />Date Due: Monday, August 11, 2008, 2:00 P.M. <br />Notice is hereby given that the City of Santa Ana, Parks, Recreation and Community Services <br />Agency has made certain modifications, additions, and/or deletions, in the specifications to Santa <br />Ana Zoo Landscape & Grounds Maintenance Specifications 8-05-08. This addendum shall <br />become a part of the original Request for Proposal due by 2:00 p.m. on August 8 2008. <br />This addendum is provided in response to questions asked at the pre -bid conference conducted <br />on Tuesday, August 5, 2008. <br />Special Provisions, Item 4. BONDS, 1) shall be eliminated as follows: <br />2. Special Provisions, Item 7. FAILURE TO PERFORM SATISFACTORILY, A. <br />shall be revised to read as follows: <br />FAILURE TO PERFORM SATISFACTORILY <br />A. It is agreed and understood that when the performance of the work or completion per <br />schedule is determined to be sub -standard or unsatisfactory the Director will: (1) <br />recommend that all or a portion of payment be withheld, and/or forfeiture for delay be <br />assessed; and, (2) direct the work be accomplished by either City forces or separate <br />contractor, in order to complete the necessary work as close to schedule as possible, <br />and withhold the resulting costs. Payment to be withheld shall be deducted from the <br />next monthly payment due the Contractor, or if the amount is insufficient to cover <br />payment, the Contractor shall be liable and will be billed accordingly. Such adjustments <br />will be the estimated cost for performance by City forces plus City overhead and will <br />include overtime pay as required to complete work. In addition the City will charge the <br />Contractor $150.00 between $100.00 and $300.00 for each item in the specification <br />they fail to complete. <br />3. Section II ROUTINE MAINTENANCE, H. HARDSCAPE MAINTENANCE, 11. Shall <br />be eliminated as follows: <br />
