Zoning Ordinance Amendment No. 2012 -03 <br />July 15, 2013 <br />Page 3 <br />In order to address this concern, the following changes have been made to the draft <br />ordinance: <br />• A new definition for "concert venues" was created <br />• Definition acknowledges that concert venues are distinct from restaurants <br />providing ancillary entertainment, i.e. music and dancing are the primary uses <br />of concert venues. <br />• A new Conditional Use Permit (CUP) category was created for concert venues. <br />• Allow existing concert venues that already have an indoor entertainment CUP <br />to convert it to a concert venue CUP subject to a public hearing and standard <br />conditions. <br />• Eliminates the need for an annual dance permit, which is a current requirement. <br />• Addresses existing non - conforming concert venues. <br />3. Permit Cost — Members of the public and representatives of the various business <br />interests affected by the ordinance expressed concerns over the issuance and renewal <br />cost of the Entertainment Permit. <br />In order to address this concern, the following changes have been made to the draft <br />ordinance: <br />• The permit fee will be the same as those used for Land Use Certificates, <br />which are currently: <br />o No fee for Category I permits. <br />o $341.22 per year for Category II permits. <br />o $611.89 per year for Category III and IV permits. <br />• Annual renewal fees would be reduced by 25% from initial application fee. <br />• Permit fees would be waived in the first year. Businesses that get their <br />permit the first year would never have to pay the initial issuance fee, only the <br />future renewal fee. <br />4. Cost Recovery Methodology for Police Services — The previously proposed ordinance <br />contained a provision to address those businesses that might violate their conditions of <br />approval and, thereby, create the need for more calls for police services, by charging <br />them a fee. Members of the public and business owners expressed concern that the <br />methodology was too vague and would penalize businesses for making legitimate calls <br />to the police. <br />In order to address this concern, the following changes have been made to the draft <br />ordinance: <br />• The entire cost recovery section was deleted. <br />• The only fee that would be charged would be for the Entertainment Permit. <br />5. Age Restrictions for Clubs and Concert Venues — A major area of concern, especially <br />for the operators of large concert venues, was the recommendation that, after 10:00 <br />75A -3 <br />
