REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />SEPTEMBER 16, 2013 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2013 -24 TO <br />ALLOW A TYPE 41 ALCOHOLIC BEVERAGE <br />CONTROL LICENSE FOR A BOUDIN RESTAURANT <br />LOCATED AT 2800 NORTH MAIN STREET, SUITE <br />1038 - JARED TAYLOR, APPLICANT <br />c'rry MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />_ •;• <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1s' Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2013 -24 as conditioned. <br />PLANNING COMMISSION ACTION <br />On August 26, 2013, the Planning Commission adopted a resolution approving Conditional Use <br />Permit No. 2013 -24 as conditioned by a vote of 7:0 which approved a Type 41 Alcoholic <br />Beverage Control license in order to sell beer and wine for on- premise consumption at the <br />Boudin Bakery restaurant located at 2800 North Main Street, Unit 1038 in the General <br />Commercial (C2) zoning district. The Planning Commission modified Condition No. 21 to <br />remove the term `or drop safe" to reflect the cash controller technology that will be installed by <br />the applicant (Exhibit A). <br />DISCUSSION <br />Boudin Bakery restaurant will be a full - service, sit -down restaurant that will feature an indoor <br />dining area, as well as an enclosed outdoor patio. The restaurant will be located on the first floor <br />of the Main Place shopping center on the south side of the JC Penney building and adjacent to <br />the Saigon de Pho restaurant. The approval of this CUP would allow for the sale and service of <br />beer and wine in conjunction with food sales. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />Jay-M.
