REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />SEPTEMBER 16, 2013 <br />TITLE: <br />CONDITIONAL USE PERMIT NO. 2013 -26 <br />AND VARIANCE NO. 2013 -09 TO ALLOW <br />THE BAT NHA BUDDHIST MEDITATION <br />CENTER AT 803 SOUTH SULLVAN STREET <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 1" Reading <br />❑ Ordinance on 2n° Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2012 -16 as conditioned <br />and Variance No. 2012 -05 as conditioned. <br />PLANNING COMMISSION ACTION <br />On August 26, 2013, the Planning Commission adopted a resolution approving Conditional Use <br />Conditional Use Permit No. 2013 -26 as conditioned to allow a church use in a residential zone, <br />Variance No. 2013 -09(a) as conditioned to allow a reduction in parking and Variance No. 2013 - <br />09(b) as conditioned to exceed the allowable building height by a vote of 7:0 to allow the <br />construction of a mediation center at 803 South Sullivan Street located in the Single Family <br />Residential (R1) zoning district. The Planning Commission made no changes to the <br />recommended conditions of approval outlined in the attached staff report (Exhibit A). <br />DISCUSSION <br />The Bat Nha Buddhist Meditation Center will be an 8,551 square foot, newly- constructed worship <br />facility which will be located on the site Bat Nha has occupied since 1996 on S. Sullivan Street. <br />The new facility will feature traditional Vietnamese temple architecture that includes several <br />elements that exceed the maximum height requirement in that zone. The project will also include <br />115 new parking spaces, the majority of which will be located in a parking podium under the new <br />facility. The approval of the CUP would allow for a church use in a residential zone. The approval <br />of the two variance requests would allow for a reduction in required parking of eight spaces and <br />will allow for the temple's architectural features to reach 48 feet in height in limited locations. <br />31 C -1 <br />
