Commencement Date. <br />4. Nexus shall pay City for item no. 4 to Exhibit A not later than approval of the first final <br />map for the Nexus Project. The City shall follow the Neighborhood Traffic Management <br />Plan Policy adopted by the City Council. <br />Construction of Item No. 5 to Exhibit A shall conform to the following schedule: <br />a. The City shall provide Nexus with a preliminary estimate of this cost within thirty <br />(30) days of the Commencement Date. This preliminary estimate shall be updated, <br />if necessary, upon the City's receipt of Nexus application to final any portion of its <br />tentative tract map. Said estimate shall be conclusive. <br />b. Nexus shall pay the City the estimated cost of this item not later than approval of <br />the first final map for the Nexus Project. <br />C. The City shall complete construction of this item prior to the first certificate of <br />occupancy for the Nexus Project. <br />Any deadline pursuant to this Exhibit C may be extended by mutual written agreement of Nexus <br />and the City Manager or designee. <br />EXHIBIT D <br />19 <br />
