4.02 Enforcement <br />(a) All of the provisions contained herein shall <br />run with the land and shall be enforceable by proceedings at <br />law or in equity. The Agency shall have the right to <br />enforce the provisions hereof, without liability for failure <br />to do so. The Agency may institute or prosecute in the name <br />of the Owner or in its own name any suit which the Agency <br />may consider advisable, including, but not limited to, a <br />suit to compel and obtain a decree for specific performance <br />of any obligation of any owner or the Dealers Association <br />pursuant to this Declaration. Any owner or the Dealers <br />Association may at any time prosecute any proceedings in law <br />or in equity in the case of any violation or attempt to <br />violate any of the covenants contained herein. Failure by <br />the Agency, the Dealers Association or any Owner to enforce <br />any covenant or restriction herein contained shall in no <br />event be deemed a waiver of the right to do so thereafter. <br />(b) Any breach of any of the foregoing covenants <br />and restrictions shall not defeat or render invalid the lien <br />of any Mortgage made in good faith and for value as to a Lot <br />or any part thereof. These covenants, conditions and <br />restrictions shall be binding upon and effective against any <br />Owner of a Lot or portion hereof whose title thereto is <br />acquired by foreclosure, turstee's sale or otherwise. <br />33 <br />8-203 <br />
