MAJOR THOROUGHFARE AND <br />FOR <br />SAN JOAQUIN HILLS AND <br />TRANSPORTATION <br />BRIDGE FEE PROGRAM <br />FOOTHILL /EASTERN <br />CORRIDORS <br />Government Code Sections 50029 and 66484.3 permit the <br />establishment of local ordinances to require payment of <br />fees as a condition of approval of a final map or as a <br />condition of issuing a building permit for purposes of <br />defraying the actual or estimated cost of constructing <br />bridges over waterways, railways, freeways and canyons, <br />or constructing major thoroughfares in Orange County. <br />Pursuant to the above provisions of the Government Code, <br />the Board of Supervisors adopted Section 7 -9 -316 of the <br />Orange County Codified Ordinances providing for the <br />establishment of major thoroughfare and bridge <br />construction fees to be paid by subdividers and building <br />permit applicants in the County of Orange. <br />On April 21, 1982, the Board of Supervisors, by <br />Resolution 82 -598, directed the Environmental Management <br />Agency (EMA) to begin analyzing potential areas of <br />benefits, and to proceed with the establishment of a fee <br />program. The Board, furthermore, determined that <br />developers of subdivisions which contain portions of any <br />transportation corridor, would dedicate right -of -way, <br />grade and construct necessary portions of the corridor <br />and participate in any established corridor fee program. <br />On February 15, 1983 the Board of Supervisors, by <br />Resolution 83 -239, identified interim areas of impact for <br />the San Joaquin Hills and Foothill /Eastern Transportation <br />Corridors and directed EMA to require subdividers to <br />enter into contracts to participate in corridor <br />implementation pending establishment of a fee program. <br />BEIM <br />
