FIRST AMENDED AND RESTATED <br />JOINT EXERCISE OF POWERS AGREEMENT <br />CREATING THE SAN JOAQUIN HILLS <br />TRANSPORTATION CORRIDOR AGENCY <br />THIS FIRST AMENDED AND RESTATED AGREEMENT is made and <br />entered into, pursuant to Sections 11.1 and 11.3, by and among <br />the following public agencies as of the /"7,tA day <br />of 1988, the date on which six or more of the <br />following public agencies executed this First Amended and <br />Restated Joint Exercise of Powers Agreement Creating the San <br />Joaquin Hills Transportation Corridor Agency: <br />(a) Coun! <br />(b) City <br />(c) City <br />(d) City <br />(e) City <br />(f) City <br />(g) City <br />(h) City <br />.y <br />of <br />of <br />of <br />of <br />of <br />of <br />of <br />if Orange <br />Costa Mesa <br />Irvine <br />Mission Viejo <br />Newport Beach <br />San Clemente <br />San Juan Capistrano <br />Santa Ana <br />R E C I T A L& <br />A. The California State Legislature adopted Chapter 708, <br />Statutes 1984, adding Section 66484.3 to the Government Code <br />authorizing the County of Orange and any city within the County <br />of Orange to require by ordinance the payment of a fee as a <br />condition of approval of a final map or as a condition of <br />issuing a building permit, for the purpose of defraying the <br />actual or estimated cost of constructing bridges over <br />waterways, railways, freeways, and canyons or constructing <br />major thoroughfares. <br />B. The Parties to this Agreement have territorial <br />jurisdiction within the Area of Benefit of the San Joaquin <br />Hills Transportation Corridor, and desire to impose such a fee <br />pursuant to Government Code Section 66484.3 in order to finance <br />the planning, acquisition and construction of major <br />thoroughfares and bridges in the San Joaquin Hills <br />Transportation Corridor. The Parties hereto have the common <br />power to conduct such transportation planning, financing and <br />construction. <br />
