EXHIBIT 12-E Local Assistance Procedures Manual <br />Attachment H PS&E Cheeldist Instructions <br />(1) A cumulative increase if $25,000 or more in the amount paid or expected to be paid for influencing or <br />attempting to influence a covered federal action; or <br />(2) A change in the person(s) or individual(s) influencing or attempting to influence a covered federal action; <br />or <br />(3) A change in the officer(s), employees(s), or member(s) contacted to influence or attempt to influence a <br />covered Federal Action. <br />2-1.02 DISADVANTAGED BUSINESS ENTERPRISE (DBE). -This project is subject to Title 49 CFR <br />26.13(b): <br />The Contractor, sub -recipient or subcontractor shall not discriminate on the basis of race, color, national <br />origin, or sex in the performance of this contract. The Contractor shall carry out applicable requirements of 49 <br />CFR, Part 26 in the award and administration of DOT -assisted contracts. Failure by the contractor to carry out <br />these requirements is a material breach of this contract, which may result in the termination of this contract or <br />such other remedy as the recipient deems appropriate. <br />Take necessary and reasonable steps to ensure that DBEs have opportunity to participate in the contract (49 CFR <br />26). <br />To ensure there is equal participation of the DBE groups specified in 49 CFR 26.5, the Agency specifies a goal <br />for Disadvantaged Business Enterprises (DBEs). DBE is a firm that meets the definition of DBE. <br />Make work available to DBEs and select work parts consistent with available DBE subcontractors and suppliers. <br />Meet the DBE goal shown in the Notice to Bidders or demonstrate that you made adequate good faith efforts to <br />meet this goal. <br />It is your responsibility to verify that the DBE firm is certified as DBE at date of bid opening.
