• Payment Plan for outstanding rent and other receivables: Owner understands <br />low income tenants with disabilities often subsist on a very limited income, <br />therefore the goal is not to place onerous payment plans on tenants. Rather <br />the goal is to get the tenant to accept responsibility. <br />• Reasonable Accommodations & Grievance Process: The RSC will assist <br />with both processes. Services offered by the RSC include: <br />• Explaining and filling out the reasonable accommodation or <br />grievance form <br />• Obtaining documents to substantiate the grievance or reasonable <br />accommodation request. <br />• Seeking alternative housing to prevent a formal eviction that <br />would make the tenant ineligible for Housing Authority rental <br />subsidy assistance. <br />• Attending the property management meeting with the tenant. <br />• If applicable advocate for the tenant <br />• If applicable provide referrals to legal services <br />• If applicable attend meetings with the tenant and outside <br />agencies <br />• In the case of approved accommodation requests that <br />necessitate alternate housing within or outside of ACOF's <br />portfolio <br />• Assist in finding alternative housing <br />• Assist in malting selection through the provision of bus <br />tokens for site visits and interviews <br />Eviction Policy: The Agent shall enforce the terms of the Residential Lease as <br />they apply to the eviction policies and procedures. All such eviction policies and <br />procedures shall be consistent with any applicable TCAC regulations and <br />regulatory agreements. The RSC will receive copies of any lease or house rule <br />violation notices that are issued to tenants, unless otherwise instructed in writing <br />by tenant. <br />Tenants who have violated their Lease or other regulations will be given a thirty <br />(30) day Notice to Vacate. Should the violation continue, the Agent will inform <br />the Owner that it intends to initiate eviction procedures. This is the opportunity <br />for RSCs to intervene to assist the tenant to preserve his /her housing. <br />Eviction for nuisance shall be undertaken only when there is documentable <br />evidence (correspondence, witnesses of illegal activities, police actions, lease <br />violations, etc.) available that the Agent and the attorney may determine to be <br />compelling in court. Court actions typically require four (4) to eight (8) weeks for <br />a decision, unless the action is not contested. Uncontested unlawful detainers <br />may require only two (2) to three (3) weeks for a decision. <br />No rent will be collected during any eviction actions. If a tenant who is in the <br />process of being evicted for nonpayment of rent desires to pay the rent in full, <br />Exhibit H - 34 - <br />
