d. All grantees shall establish written procurement procedures that meet the requirements set <br />forth in applicable statutes, regulations, and related laws, and in this Appendix. <br />2. Contract Provisions <br />The following section also contains the types of provisions that must be included in IiMLS- <br />funded grantee procurement contracts when applicable and consistent with applicable law. <br />Please note that the Contract Provisions below are given for general guidance; the grantee should <br />follow the specific regulations and provisions that correspond to the grantee's organizational <br />identity (e.g. 2 CFR Part 215 for institutions of higher education, hospitals, and nonprofit <br />organizations or 45 CFR Part 1183 for State, local, and Indian tribal governments) and other law, <br />as applicable. <br />a. Grantee contracts must provide for: <br />(1) Administrative, contractual, or legal remedies in instances where contractors violate or <br />breach contract terms, and such remedial actions as may be appropriate. <br />(2) Termination by the grantee, including the manner by which it will be effected and the <br />basis for settlement. <br />(3) Access by the grantee, IMI LS, the Comptroller General of the United States, or any other <br />duly authorized representatives to any books, documents, papers, and records of the <br />contractor which are directly pertinent to that specific contract for the purpose of malting <br />audit, examination, excerpts, and transcriptions, <br />b. Contracts shall contain the following provisions as applicable: <br />(1) Equal Employment Opportunity <br />(2) Copeland "Anti - Kickback" Act <br />(3) Contract Work Hours and Safety Standards Act <br />(4) Clean Air Act <br />(5)Rights to Inventions and Materials Generated Under a Contract or Agreement (Contracts <br />or agreements for the performance of experimental, developmental, or research work <br />shall provide for the rights of the Government and the recipient in any resulting invention <br />in accordance with 37 CFR Part 401 and any implementing regulations issued by the <br />awarding agency.) <br />(6) Federal Water Pollution Control Act (33 U.S.C. §1251 et seq.), as amended <br />(7) Byrd Anti - Lobbying Amendment (31 U.S.C. § 1352) <br />(8) Debarment and Suspension (E.O. 12549 and 12689) <br />No contracts shall be made to parties listed on the Lists of Parties Excluded From <br />Federal Procurement or Nonprocurement Programs (EPLS) in accordance with <br />Executive Orders 12549 and 12689. These lists contain the names of contractors <br />debarred, suspended, or proposed for debarment by agencies, and contractors <br />declared ineligible under other statutory or regulatory authority other than Executive <br />Order 12549. <br />25 <br />
