Poke Cf) MAY 2 0 <br />THIS FIRST AMENDMENT TO ELEVATOR CONSULTING AGREEMENT is <br />entered into can March 30, 2015 by and between HKA Elevator Consulting Inc,, ("Contractor") <br />and the City of Santa Ana, a charter city And municipal corporation organized and existing under <br />the Constitution and laws of the State of California C'City"). <br />REen'ALS: <br />A. The parties entered into an Agreement #N-2014-154, dated Noverahm, 17, 2014, (hereinafter <br />"said Agreement") by which Contractor has assessed the Santa Ana Detention Center <br />elevator maintenance needs. <br />,B. Contractor provided An initial assessment and now a follow up assessment is needed in <br />connection with firalings on 5H elevator drive repairs, <br />Cx In accordance with the terms and conditions of said Agreement, the parties wish to Amend the <br />original agreement to increase the compensation to pay for the additional assessment by <br />$2900 to pay for the additional,services, reflect the additional services to be provided, and to <br />increase the contingency amount from $18QQ to $4,000 for use at the sole discretion of the <br />City. <br />WHEREF ORE, in consideration of the covenants contained in said Agmement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this First Amendment to <br />Agreement, the parties agree as fbllowsr <br />Z. Section 1, SCOPE OF SERVICES, shall be,amended to reflect that a, follow up assessment <br />related to the findings on elevator 5H and any additional inspections and(or reports that the <br />City may deers necessary for quality control and safety assurances. <br />1 Section 2.A, COMPENSATION, shall be amended to increase the componsatioD by $2,900 <br />with an increase of the contingency frota, $1,800 to $4,000 for use at the City's sole discretion. <br />After amendment, the agreement will not exceed $9,400 And a $4,000 contingency for a total <br />of $13,400 to pay for additional services provided during the extended term of this <br />Agreement, <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in <br />full force and e6ect. <br />
