Resolution for FPPC <br />Ticket Distribution Policy <br />April 6, 2009 <br />Page 2 <br />at the behest of a designated official, i.e., to a third party, <br />accomplish those same public purposes; and 3) a provision prohibiting <br />the transfer by the official of such tickets except to members of the <br />official's immediate family, solely for their personal use. <br />The regulation also requires that the City disclose on its website all <br />complementary tickets distributed to or by its designated officials <br />under the policy. Such disclosure is to be made within 30 days after <br />the distribution on a form provided by the FPPC (Form 802). The <br />information disclosed must include 1) the name of the person or <br />organization receiving the tickets; 2) a description of the event; 3) <br />the date of the event; 4) the face value of the ticket; 5) the number of <br />tickets provided to each person or organization; 6) if the ticket was <br />behested (given to a third person oh behalf of the official), the name <br />of the official who behested the ticket; and 7) a description of the <br />public purpose under which the distribution was made or, alternatively, <br />that the ticket will be treated as income by the official. <br />There are numerous exceptions to the regulation. Among those are: where <br />the designated official pays face value for the ticket, where the <br />designated official performs a official function at the event on behalf <br />of the City; or where the ticket is given directly to the designated <br />official but must be disclosed on the official's Form 700. <br />Additionally, the regulation does not apply to tickets or passes <br />distributed by the City to non - designated officials, to events where <br />there is no admission fee, or to civic, community and cultural <br />activities such as employee recognitions, neighborhood events, state of <br />the city addresses and community prayer programs. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this item. <br />55B -2 <br />
