Box 1988 <br />Santa Ana, CA 92702 <br />APN: 408-261-22 <br />(Space Above This Line For Recorder's Use Only) <br />2015 MEMORANDUM OF UNDERSTANDING <br />(EMERGENCY SHELTER MANAGEMENT & OPERATIONS PLAN) <br />(1710 West Edinger Avenue, Santa Ana, CA) N-2015-159 <br />This Memorandum of Understanding is entered into on this 17th day of August, 2015, by The <br />Salvation Army, a 501(c)(3) tax exempt non-profit organization, having a mailing address of <br />P.O. Box 93002, Long Beach, CA 90809-3002 (hereinafter referred to as "Operator") and the <br />City of Santa Ana, a charter city and municipal corporation, having a mailing address of 20 Civic <br />Center Plaza, P.O. Box 1988, Santa Ana, CA 92702 (hereinafter referred to as "City"). <br />1. Operator has filed with City an `Emergency Shelter Management and Operations <br />Plan" ("MOP"), pertaining to a certain property located at 1710 West Edinger <br />Avenue, Santa Ana, California, dated the 31st day of July 2015, as required by Santa <br />Ana Municipal Code section 41-1201(8). Said MOP serves the purpose of setting <br />forth guidelines and rules for administration of a temporary emergency shelter <br />facility ("The Salvation Army Hospitality House") and other improvements. All of <br />the foregoing is set forth in the MOP. <br />2. The term of the MOP shall be for as long as the property is used as a temporary <br />emergency shelter. <br />3. The full MOP, as amended from time to time, is on file with the City of Santa Ana <br />and can be reviewed at 20 Civic Center Plaza, 2nd Floor, contact Planning Division. <br />4. This Memorandum of Understanding is not intended to amend or modify, and shall <br />not be deemed or construed as amending or modifying, any of the terms, conditions <br />or provisions of the MOP, all of which are hereby ratified and affirmed. In the event <br />of a conflict between the provisions of this Memorandum of Understanding and the <br />provisions of the MOP, the detailed provisions of the MOP shall control. The <br />Agreement shall be binding upon and inure to the benefit of the parties and their <br />respective heirs, successors, and assigns, subject to the provisions of the MOP. <br />
