6. The City received a total of eight written comment letters during the <br />public review period and evaluated all comments received from the <br />persons or agencies that reviewed the Draft EIR. Pursuant to <br />Section 15088 of the State CEQA Guidelines, the City, as the lead <br />agency for the project, has reviewed all comments received on the <br />document. The City provided written responses to all agencies and <br />members of the public commenting on the Draft EIR at least 10 <br />days prior to the Planning Commission hearing and 30 days prior to <br />certification of the EIR. <br />7. The City has prepared a Final EIR, consisting of comments and <br />recommendations received during the 45 -day public review and <br />comment period on the Draft EIR, written responses to those <br />comments, and revisions and clarifications to the Draft EIR in <br />response to those comments. For the purposes of this Resolution, <br />the "EIR" shall refer to the Draft EIR, including all of the technical <br />studies and appendices to the Draft EIR, as revised by the Final <br />EIR's revisions, together with the other sections of the Final EIR, <br />including all of the technical studies, attachments and appendices <br />to the Final EIR. <br />8. Findings of Fact with respect to environmental impacts, including <br />environmental impacts identified in the Final EIR as potentially <br />significant, but which the City finds can be substantially lessened <br />through the imposition of feasible mitigation measures identified in <br />the Final EIR, are described in Exhibit A attached hereto and <br />incorporated herein by this reference. <br />9. As a result of the environmental analysis, two significant impacts <br />were found from the construction of the proposed project that <br />pertains to air quality and traffic, Accordingly, the City has also <br />prepared a Statement of Overriding Considerations in compliance <br />with Public Resources Code Sections 21081 and CEQA Guidelines <br />Section 15093, which finds that specific economic, legal, social, <br />technological or other benefits of the proposed project outweigh the <br />significant and unavoidable impacts identified in the EIR, as <br />described in Exhibit 6 attached hereto and incorporated herein by <br />this reference, <br />10. Mitigation measures have also been provided to address potential <br />environmental impacts, with a list of these mitigation measures <br />found within the Mitigation Monitoring and Reporting Program <br />attached hereto as Exhibit C and incorporated herein by this <br />reference.
