4. An obligation, as required by ordinance,toin-
<br />demnify amum/cipality, except mconnection
<br />with work for amunicipality;

<br />pertaining to your business (including an in-
<br />demnification of a municipality in connection
<br />with work performed for a municipality) under
<br />which you assume the tort liability ofanother to
<br />pay for "bodily injmry" or "property damage" to
<br />a third party or organization. Tort liability
<br />means a liability that would be imposed by ]am
<br />in the absence ofany contract uragruememt�,
<br />6. That part cfany contract oragreement entered
<br />into, as part ofyour business, pertaining to, 'the
<br />rental or |eame, by you or any of your "employ-
<br />ees", of any "auto". However, such contract or
<br />agreement shall not be considered an ^inmmnsd
<br />contract' to the extent that hobligates you or
<br />any of your "employees" to pay for "property
<br />damage" toany ''au1u"rented urleased byyou
<br />orany ofyour ''enopYoyeea"
<br />An"insured contract" does not include that part of
<br />any contract or agreement:
<br />o. That indemnifies m railroad for "bodily in-
<br />jury~ or "property damage" arising out of
<br />construction ordemolition operations, within
<br />50 feet of any railroad property and affect-
<br />ing any railroad bridge or tneat|e, tnacka,
<br />roadbeds, tunnel, underpass orcrossing; or
<br />lb. That pertains to the loan, lease or mymta| of
<br />an ^auto" to you or any of your 'emp|oy-
<br />ees'', if the "auto" is loaned, leased or
<br />rented with a driver; or
<br />c. That holds a person or organization em -
<br />gaged in the business of transporting prop-
<br />erty by''autn"for hire harmless for your use
<br />of covered ^outo" over a route or territory
<br />that person or organization is authorized to
<br />serve bypublic authority.
<br />L "Leased worker" means eperson leased boyou by
<br />a labor leasing firm under an agreement between
<br />you and the labor leasing firm, toperform duties
<br />na|mhad to the conduct of your business. "Leased
<br />worker' does not include a"temporary worker'
<br />J. "Loss"' means direct and accidental loss or dam-
<br />age.
<br />K. "Mobile equipment' means any of the fo||ovv�mQ
<br />types ofland vehicles, including any attached ma-
<br />chinery ormqmipment�
<br />1. Bulldozers, farm machinery, forklifts and other
<br />vehicles designed for use principally off public
<br />3. Vehicles that travel on crawler treads;
<br />4~ Vehkdee, whether self - or not, main-
<br />tained primarily to provide mobility to penna-
<br />nentlymoumtad:
<br />a. Power cranes, shmve8s. |nadere, diggers or
<br />drills; or
<br />b. Road construction urresurfacing equipment
<br />such msgraders, scrapers orrollers.
<br />6. Vehicles not desohbedin Paragraph 1 2 3
<br />or 4. above that are not self-propelled and are
<br />maintained primarily to provide mobility to per-
<br />manently attached equipment ofthe following
<br />types:
<br />a. Air numpnaeaons, pumps and Qenenetoca,
<br />including aprayinQ, vveFding, building o|ean-
<br />ing, geophysical exploration, lighting and
<br />well servicing equipmemt� or
<br />b. Cherry pickers and similar devices used to
<br />raise orlower workers.
<br />6. Vehicies, notdeacribed in Paragraph 1 2 3
<br />or 4. above maintained primarily for purposes
<br />other than the transportation of persons or
<br />cargo. However, self-propelled vehicles with
<br />the following types of permanently attached
<br />equipment are not "mobile equipment" but will
<br />be considered "autos":
<br />a. Equipment designed primarily for
<br />(1) Snow removal;
<br />(2) Road maintenance, but not construction
<br />orresurfacing; pr
<br />(%) Street cleaning I
<br />b� Cherry pickers and similar devices mounted
<br />on automobile or truck dnaomie and used to
<br />raise orlower workers; and
<br />c. Air oompnsssonm, pumps and generators,
<br />including spraying, welding, building mmam-
<br />img,geophysical exploration, lighting orwell
<br />aenvicinQequ�pmemL
<br />However. "mobile equipment" does not include
<br />]end vehicles that are subject to a compulsory or
<br />financial responsibility |mm or other motor vehicle
<br />insurance law vvhemm it is licensed or principally
<br />garaged. Land vehicles subject toecompulsory or
<br />financial responsibility |avv or other motor vehicle
<br />insurance law are considered "autos".
<br />L. "Pollutants" means any solid, liquid, gaseous or
<br />thermal irritant or mmntmminmnt, including oke.
<br />vopmr, moot, fumem, aoids, a|ka|ie, chemicals and
<br />waste. Waste includes materials to be recycled,
<br />reconditioned mrreclaimed.
<br />2. Vehicles maintained for use solely o M. "Propertymeans damage to or loss of
<br />premises you own mrrent; use of tangible property.
