E. The private sector members are to be nominated by a business service organization, such as the Chamber of Commerce, and the labor, non - profit and public sector nominations are to be nominated by their respective organizations. The City Council shall review the nominations in order to appoint. F. The City shall serve the proper notice upon the WIB to terminate, due to the fact that the City will no longer be an LWIA under the WIA because WIOA took effect on July 1, 2015. G. The establishment of the WDB is necessary in order to bring WIOA funds into the City of Santa Ana. Section 2. The Workforce Development Board ("WDB") is hereby established pursuant to the Workforce Innovation and Opportunity Act ( "WIOA ") in orderto ensure the involvement of the business community, including small businesses, minority business enterprises, education, labor organizations, economic development agencies and one - stop delivery system partners in workforce investment activities, as well as to lead efforts to develop and implement career pathways within the local area by aligning the employment, training, education and supportive services that are needed by adults and youth, particularly individuals with barriers to employment. Section 3. The Mayor and City Council, after review of the private and public sector nominations for membership, ratifies such nominations and establishes the initial individuals to serve on the Board of the WDB. A list of the Board nominations is attached hereto as Exhibit A and incorporated herein by this reference. Hereafter, the individuals who serve on the Board shall be appointed and may be removed and vacancies may be filled by the Mayor and City Council by motion as provided by section 901 of the City Charter, to the extent that such Charter provisions do not conflict with the WIOA. Section 4. Pursuant to this Resolution, the Workforce Investment Board is hereby dissolved of all duties and responsibilities, and the newly established WDB shall act to implement the WIOA. Section 5. If any section, subsection, sentence, clause, phrase or word of this Resolution is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have passed and adopted this Resolution, and each and all provisions hereof, irrespective of the fact that one or more provisions may be declared invalid.
