11. Provide the following formulas: <br />a. Daylight Overdraft <br />b. Overnight Overdraft <br />c. FDIC Insurance <br />d. Service Charge Credit <br />C. Once the contract has been awarded, the Bank will not be permitted to charge the City for <br />any fees not listed on the Cost /Bid Form. The only exceptions to this limitation will be if the <br />City specifically requests additional services not identified in the RFP or in Bank's proposal. <br />The fees for new services will be negotiated and added to the contract as an amendment or <br />through a change order process. However, if a regulatory agency imposes a fee to the Bank <br />which is passed through to all Bank customers then all such fees shall be accommodated. <br />D. It is understood that the dollar amounts and quantities specified hereafter are estimates <br />based upon past experiences. However, the actual number of transactions will vary, and <br />the City makes no guarantees regarding minimum or maximum volumes. The Bank should <br />specify the variance allowed from the estimates without changing the bid amount. <br />E. The City reserves the right to retain all proposals and prices shall remain firm for a period of <br />at least one hundred and twenty (120) days for examination and comparison, The City <br />reserves the right to waive non - substantial irregularities in any proposal, to reject any or all <br />proposals, and to reject one service category of a proposal and accept another, except to <br />the extent that proposals are qualified by specific limitations by the proposer. <br />F. Proposers are encouraged to propose alternatives to the listed requirements that will reduce <br />cost and enhance service. The City will evaluate these alternatives on an individual basis. <br />Alternative services should be listed separately on the Cost /Bid Form. All services listed <br />must be priced even though an alternative service has been proposed. <br />G. Any successful proposer shall be required to post collateral and comply with depository <br />regulations in accordance with the California Government Code, City of Santa Ana Charter <br />and Municipal Code, and other applicable state and federal laws. <br />VI. PROPOSAL FORMAT — DATA REQUIRED <br />The content and sequence of the information contained in each copy of the proposal shall be as <br />follows (see also Attachment 11 - Data Required): <br />A. Letter of Transmittal <br />Include your bank's understanding of the work to be performed. Additionally, state why <br />your bank believes it is the best qualified to perform the services requested. Include the <br />Management Contact (Representative authorized to sign an agreement for your financial <br />banking institution) and the Project Manager (person responsible for the day -to -day <br />management of the project). <br />B.
