(d) Rates for roll-off services, including container <br /> delivery, collection and transportation shall be as follows <br /> beginning on July 1, 1994 : <br /> Container Size Rate Additional Fee for Compactor <br /> 10 cubic yard <br /> 20 cubic yard <br /> 40 cubic yard <br /> In addition to the above container service rates, Contractor <br /> shall charge the roll-off service customer for the actual gate fees <br /> paid at either the disposal site or materials recovery facility. <br /> 24. ANNUAL ADJUSTMENTS TO CHARGES: <br /> (a) HAULING AND PROCESSING CHARGES: The hauling charges and <br /> processing charges shall be adjusted annually beginning on July 1, <br /> 1994 . The hauling charge and processing charge shall be adjusted <br /> in accordance with the rate adjustment procedure set forth below: <br /> The two indices which will be used for determining the annual <br /> adjustments shall be the December Consumer Price Index ("CPI") for <br /> All Urban Consumers (base years 1982-1984 = 100) for Los Angeles- <br /> Anaheim-Riverside CMSA, published by the United States Department <br /> of Labor, Bureau of Labor Statistics with a seven (7%) percent <br /> maximum adjustment per year which will be weighted at ninety (90%) <br /> percent and the December Producer Price Index, Diesel Fuel #2 <br /> (#057303) which will be weighted at ten (10%) percent. The <br /> adjustment to the charges shall be effective on July 1st of each <br /> applicable year. <br /> (b) LANDFILL CHARGES: Should any increase in the gate fees <br /> charged by a licensed landfill occur during the term of this <br /> Agreement, CONTRACTOR shall be permitted to pass through to both <br /> it's bin service customers and it's roll-off service customers, and <br /> CITY shall pass through to its curbside service users, seventy five <br /> percent (75%) of any such increase in the gate fees for solid waste <br /> taken directly to a materials recovery facility and one hundred <br /> percent (100%) of any such increase in the gate fees for solid <br /> waste which is taken directly to a landfill. <br /> 25. SPECIAL BIN SERVICES AND CUSTOMER SERVICE REQUIREMENTS: <br /> (a) The CONTRACTOR may enter into agreements with bin service <br /> customers for special collection services different from, in <br /> addition to, or greater than the minimum collection services <br /> required by this Agreement. The following special fees may be <br /> charged to bin service customers: <br /> (1) A bin which needs to be moved in excess of twenty <br /> 22 <br />
