IX. LITIGATION <br /> Great Western Reclamation is an unincorporated division of Waste Management <br /> Collection and Recycling, Inc. Waste Management Collection and Recycling, Inc. is a <br /> wholly owned subsidiary of Waste Management of North America, Inc., an Illinois <br /> corporation, located at 3003 Butterfield Road., Oak Brook, Illinois 60521 ("WMNA"). Other <br /> parent company subsidiaries having operations in the state of California are: i) Waste <br /> Management of Orange County, Inc.; (ii) Waste Management of California, Inc.; (Hi) <br /> Oakland Scavenger Company; and (iv) Waste Management Disposal Services of <br /> California, Inc. <br /> The above named companies currently may have routine claims, settlements, <br /> arbitration and litigation involving property damage, personal injury, employment, traffic <br /> violations, operational issues and other miscellaneous matters ("Claims") in progress. <br /> None of the Claims are material to the Contractor's financial stability and none of the <br /> Claims are out of the normal course of business for companies involved in the <br /> environmental services business. The following is a list of significant actions relative to <br /> each of the aforementioned companies. <br /> A. The following is in respect to Waste Management Collection and Recycling. <br /> Inc. <br /> 1. Waste Management Collection and Recycling, Inc., was charged with a <br /> statutory violation of the California unfair competition law in People of the <br /> State of California vs. Inland Disposal. Inc., et. al., No. 167853. On <br /> September 2, 1992, the Riverside County, California District Attorney filed <br /> a complaint regarding the Company's operation of overweight vehicles. The <br /> complaint was settled the same day pursuant to a negotiated settlement <br /> wherein the Company paid a civil penalty and agreed not to violate the <br /> Vehicle Code weight restrictions in the future. <br /> 2 <br />
