4. The Guarantor hereby unconditionally waives presentment, notice of <br /> dishonor, protest, demand for payment and all notices of any kind, including, without <br /> limitation, (i) notice of acceptance hereof; (ii) notice of the creation of any of the <br /> Obligations; (iii) notice of nonpayment, nonperformance or other default on any of the <br /> Obligations; and (iv) notice of any action taken to collect upon or enforce any of the <br /> Obligations. <br /> 5. This Agreement shall inure to the City of Santa Ana and shall be <br /> binding upon the Guarantor and its successors and assigns. <br /> 6. This Agreement shall be governed by the laws of the State of California <br /> applicable to contracts made and to be performed therein between residents thereof. <br /> 7.
