A-2017.180 <br />SETTLEMENT AGREEMENT <br />AND MUTUAL RELEASE OF CLAIMS <br />This Settlement Agreement and Mutual Release of Claims (hereinafter referred to as the <br />"AGREEMENT") is entered into by and between the City of Santa Ana, a charter city and <br />municipal corporation duly organized and existing under the Constitution and laws of the State of <br />California ("CITY"), and VERONICA ROSALES ("ROSALES") AND ROBERT` PATER <br />GONZALES ("GONZALES"). The CITY and ROSALES AND GONZALES are hereinafter <br />sometimes referred to individually as "PARTY" and collectively as the "PARTIES." The <br />Effective Date of this AGREEMENT shall be the date on which the AGREEMENT has been fully <br />executed by the CITY, ROSALES, AND GONZALES. In order to avoid the costs, expense, and <br />uncertainty of protracted litigation, the PARTIES hereby enter into this AGREEMENT as set forth <br />below. <br />RECITALS <br />This AGREEMENT is based on the following facts, with these Recitals incorporated into <br />the AGREEMENT as settlement components expressly relied upon by the PARTIES: <br />A. ROSALES owns and operates a dental office, commonly known as Veronica Rosales, <br />D.D.S. located at 1417 North Bristol Street, Santa Ana, CA 92706, APN 405-252-17 <br />("DENTIST PROPERTY"). ROSALES also owns the DENTIST PROPERTY, which is <br />unencumbered. <br />B. GONZALES owns and operates an optometry business, commonly known as Dr. Robert <br />Gonzales, Optometrist, located at 1415 North Bristol Street, Santa Ana, CA 92706, APN <br />405-272-19 ("OPTOMETRIST PROPERTY"). <br />OPTOMETRIST PROPERTY, which is unencumbered. <br />4535406.1 --N1475.1 <br />GONZALES also owns the <br />eA <br />
