contracts entered into or indebtedness incurred upon the exercise of <br />such right may be in the name of the Recipient, and for such <br />purposes and the other purposes of this Paragraph 22 the <br />Department is hereby authorized and irrevocably appointed <br />attorney-in-fact (said appointment being coupled with an interest) to <br />enter into said contracts or agreements or contracts or agreements <br />theretofore made by or on behalf of Recipient and to do any and all <br />things necessary or proper to complete the work of construction, <br />including the signing of Recipient's name to such contracts and <br />documents as may be deemed necessary by counsel for the <br />Department. <br />In addition to the foregoing and not in limitation thereof, the Recipient <br />hereby further empowers the Department as said attorney-in-fact as <br />follows: (i) to use any Program Funds for the purpose of completing <br />the construction of the HRI or TRI in the manner called for by the <br />Scope of Work; (ii) to make such additions, changes and corrections <br />in the Scope of Work as shall be necessary or desirable to complete <br />the HRI, STI, or TRA in substantially the manner contemplated by <br />the Scope of Work; (iii) to employ such contractors, subcontractors, <br />agents, architects and inspectors as shall be required for said <br />purposes; (iv) to pay, settle or compromise all existing bills and <br />claims which may be liens against the Property, the HRI, STI or TRA, <br />or any part thereof, or as may be necessary or desirable for the <br />completion of the construction of the HRI, STI, or TRA, or for <br />clearance of title; (v) to execute all applications and certificates in the <br />name of the Recipient which may be required by the Construction <br />Contract or documents entered into in connection therewith; (vi) to <br />prosecute and defend all actions and proceedings in connection with <br />the Property or the construction of the HRI, STI, or TRA and to take <br />such action and require such performance necessary; and (vii) to do <br />any and every act which the Recipient might do in its own behalf with <br />regard to completion of the construction of the HRI, STI, or TRA. In <br />no event shall the Department be required to expend its own funds <br />to complete the HRI, STI, or TRA if the remaining Program Funds <br />are insufficient, but the Department may, at its option, advance such <br />funds. <br />d. Stoppage of Construction. Upon an Event of Default specified in <br />subparagraph (b)(i), (b)(iv) or (g)(iv) of Paragraph 21, the <br />Department may order immediate stoppage of construction and <br />demand that the condition be corrected, notwithstanding any right of <br />Recipient under this Agreement to correct or insure against such <br />defects.
