DEDUCTIBLES
The State may expressly allow deductible clauses, which it does not
consider excessive, overly broad, or harmful to the interests of the State.
Regardless of the allowance of exclusions or deductions by the State, the
Contractor is responsible for any deductible amount and shall warrant that
the coverage provided to the State is in accordance with Section 2(b),
"Insurance."
k. ENFORCEMENT
The Department may assure the Contractor's compliance with its
insurance obligations. Ten days before an insurance policy lapses
or is canceled during the contract period, the Contractor shall submit
to the Department evidence of renewal or replacement of the policy.
If the Contractor fails to maintain any required insurance coverage,
the Department may maintain this coverage and withhold or charge
the expense to the Contractor or terminate the Contractor's control
of the work.
The Contractor is not relieved of its duties and responsibilities to
indemnify, defend, and hold harmless the State, its officers, agents,
and employees by the Department's acceptance of insurance
policies and certificates.
4. Minimum insurance coverage amounts do not relieve the Contractor
for liability in excess of such coverage, nor do they preclude the State
from taking other actions available to it, including the withholding of
funds under this contract.
16-AHSC-11200
NOFA 02/29/16 Page 35 of 36
Rev: 03/16/17
Project: Santa Ana Arts Collective
Prep Date: 08/08/1 17
