managers, and the accuracy of all applications for payment and the proper <br />application of all disbursements. <br />11. Delay. Recipient shall promptly notify the Department in writing of any event <br />causing delay or interruption of construction work, in excess of (3) three <br />working days, or the timely completion of construction for a period of (5) five <br />working days beyond the scheduled completion date. The notice shall <br />specify the particular work delayed and the cause and period of each delay. <br />12. Purchase of Materials Under Title Retention Agreement. The Recipient <br />shall not purchase or install or permit to be purchased or installed any <br />materials, equipment, fixtures or other part of the HRI, STI, or TRA under <br />any agreements or arrangements wherein the supplier or seller reserves or <br />purports to reserve the right to remove or to repossess any such items or to <br />consider them personal property after their incorporation into the HRI, STI, <br />or TRA, unless authorized in writing by the Department. <br />13. Liens and Stop Notices. If a claim of lien is recorded affecting the Property, <br />or the Work or a bonded stop notice is served upon the Department which <br />affects Program Funds or the Recipient's other funding, Recipient shall, <br />within twenty (20) days of such recording or service or within five (5) days <br />of the Department's demand (whichever last occurs): (i) pay and fully <br />discharge the same; (ii) effect the release thereof by recording or delivering <br />to the Department a surety bond in sufficient form and amount, or otherwise; <br />or (iii) provide the Department with other assurance which the Department <br />deems, in its sole discretion, to be satisfactory for the payment of such lien <br />or bonded stop notice and for the full and continuous protection of the <br />Department from the effect of such lien or bonded stop notice. If Recipient <br />has not received actual notice of the claim of lien or bonded stop notice prior <br />to the Department's demand, then the five (5) day period described above <br />shall be extended to twenty (20) days. Recipient shall give the Department <br />prompt written notice of all lien claims affecting the Property, or the Work. <br />14. General Conditions of Disbursement.
