An enforceable option to purchase or lease which shall extend through the anticipated <br />date of the Program award as specified in the NOFA; <br />D. An executed disposition and development agreement, right of way, or irrevocable offer <br />of dedication to a Public Agency„ <br />E. An executed encroachment permit for construction of improvements or facilities within <br />the public right of way or on public land; <br />F. An executed agreement with a public agency that gives the applicant exclusive rights <br />to negotiate with the agency for the acquisition of the site; provided that the major <br />terms of the acquisition have been agreed to by all parties, <br />G. A land sales contract or enforceable agreement for acquisition of the property, or <br />H. Other forms of site control that give the Department equivalent assurance that the <br />applicant or developer will be able to complete the Work and all housing designated <br />in the Application in a timely mangier and in accordance with all the requirements of <br />the Program, <br />The Recipient shall also obtain all licenses, easements and rights-of-way or other interests <br />required for completion of the Work, and provide evidence of such Instruments prior to the first <br />disbursement of Program funds. <br />61 Appraisals <br />Recipient shall, at the request of the Department, provide an appraisal of the real property to be <br />acquired as part of the Work, prepared in a form, and by a qualified appraiser, acceptable to the <br />Department. <br />Relocation Plan <br />If there is or will be any residential or commercial displacement directly or indirectly caused by <br />the Work, as defined In state law, the Recipient shall provide a relocation plan conforming to the <br />requirements of state law and regulations issued by the Department in California Code of <br />Regulations, Title 25, section 6000 et seq. In addition to the regulatory requirements, the <br />relocation plan shall contain a line Item budget.
