Jeffrey Fertal <br />809 Grovemont Street <br />Santa Ana, CA 92706 <br />October 27, 2017 <br />Santa Ana City Council <br />20 Civic Center Plaza <br />Santa Ana, CA 92701 <br />RE: ACCESSORY DWELLING UNITS ORDINACE <br />Dear Honorable Mayor and members of the City Council, <br />My name is Jeffrey Fertal, a resident of Santa Ana. I expect to close escrow on a home very soon for a <br />property located at 1801 N. Bush Street. The subject property is an existing single- family residence and <br />is a Legal Non -Conforming Use on a property currently zoned (P) Professional. <br />This letter serves as a written request to the City Council to consider a revision to the proposed <br />Ordinance regulating Accessory Dwelling Units (ADUs). As drafted, the proposed Ordinance would not <br />permit an ADU on a property that is not zoned for Single Family use. Unfortunately, there are dozens, <br />perhaps hundreds, of existing single-family properties within the City of Santa Ana that are not currently <br />zoned for single family use, that would be prohibited from constructing an ADU. In all likely hood, these <br />properties may never be developed or used as permitted under their existing zoning designation. <br />Consequently, these single family residential properties will be unfairly discriminated from benefiting <br />from the ADU Ordinance. <br />The intent of the State's Revised ADU Bill is to increase the opportunities to construct ADUs and provide <br />more flexibility in the development and approval of these units. Therefore, I respectfully request that <br />the City Council consider revising the proposed Ordinance to include more flexibility as provided below: <br />"Accessory Dwelling Units (ADUs) shall be permitted on properties that contain a single-family <br />residence but are Legal Non -Conforming Use. The ADU shall only be permissible on eligible Legal Non - <br />Conforming properties during such time that the property is used as a single-family residence." <br />My intent to construct an ADU at 1801 N. Bush Street is to provide living quarters for my mother in-law. <br />She is not physically able to reside in the main house where the bedrooms and bathrooms are on the <br />second story. The ADU will provide her with a safe and accessible living quarter. If the proposed <br />language is too broad, perhaps the approval of an ADU on Legal Non -Conforming lots can be considered <br />by the City Manager on a case by case basis. <br />Thank you for your consideration of my request. <br />Jeffrey FertaI <br />EXHIBIT C <br />7501-47 <br />
