G. The Planning Commission of the City of Santa Ana determines that <br />following findings, which must be established in order to grant Variance <br />No. 2017-03, have been established as required by SAMC Section 41- <br />638: <br />1. That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, the strict application of the zoning ordinance is found <br />to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />Chapter. <br />The project site has a special circumstance related to its <br />location and surroundings. The proposed project will be <br />located on a site completely built -out by commercial and <br />industrial uses that restrict the site from providing additional <br />parking spaces. In addition, the site is surrounded by parking <br />lots that have ample parking during the off-peak hours when <br />demand is greatest for the proposed use. Further, the <br />parking analysis conducted by Hartzog and Crabill, has <br />concluded that the proposed number of parking spaces on- <br />site and those proposed through the shared parking <br />agreement with Orange County Credit Union will create a <br />surplus of parking and will be sufficient to meet the current <br />and future demands of both organizations. As a result, the <br />parking variance will allow the Applicant the ability to use the <br />property in a manner that is consistent with the surrounding <br />commercial and industrial uses. <br />2. That the granting of a variance is necessary for the preservation <br />and enjoyment of one (1) or more substantial property rights. <br />The granting of this variance is necessary for the <br />preservation and enjoyment of substantial property rights. <br />The granting of the parking variance will preserve the <br />property owner's ability to develop a vacant lot with a use <br />that is allowed in the specific development and will assist in <br />revitalizing the area and will provide a new facility to an <br />organization that has been a member of the Santa Ana <br />community for over 100 years. <br />3. That the granting of a variance will not be materially detrimental to <br />the public welfare or injurious to surrounding property. <br />The granting of the variance will not be detrimental to the <br />public or surrounding properties.
