indemnify, and save harmless the City of Santa Ana, its officers and <br />employees from any kind and all claims to demands, suits, actions or <br />proceedings of any kind or nature, including, but not by way of limitations, <br />workers' compensation claims, resulting from or arising out of the negligent <br />acts, errors, or omissions, arising out of the intentional or malicious acts of <br />the Union's representatives. <br />11. The Union and the City of Santa Ana agree that the Union Chapter <br />Chair/President will not be required to carry out any City duties during the <br />time the Union Chapter Chair/President is on Chapter Chair/President's <br />leave for half of the normal work week. The Chapter Chair/President will <br />be required to comply with the rules and regulations of the City of Santa <br />Ana as they apply to off-duty employees, except such Union Chapter <br />Chair/President will not be required to report to work for any purpose during <br />the half of the normal work week of Union Chapter Chair/President's leave <br />time. <br />12. Upon return to duty from Chapter Chair/President's Leave of half of the <br />normal work week. The Union Chapter Chair/President shall be restored to <br />the same position without loss of any benefits as he or she would have <br />occupied or accrued if there had been no disruption in duty status. <br />Release of employees for Union Business Leave shall be on the <br />same basis as employees are released from duty for vacation leave, <br />except that such requests for leave shall not unreasonably interfere <br />with the operation of the City department and shall be approved by <br />the employee's Department Head. The employee taking Union <br />Business Leave shall not unreasonably interfere with the operation <br />of the City department and shall be approved by the employee's <br />Department Head. The Department Head shall not unreasonably <br />withhold permission to utilize Chapter Chair/President's Leave time <br />and/or Union Business Leave from any employee who has been duly <br />authorized by the Union to take such leave. <br />The Union Chapter Chair/President shall have half of the normal <br />work week or one thousand forty (1,040) hours per year of time off <br />to conduct Union business which shall be paid by the City, but <br />reimbursed to the City by the Union directly from the Union. <br />59 <br />25B-61 <br />
