Resolution No. 2017-xx <br />Page 1 of 7 <br />RESOLUTION NO. 2017-xx <br />A RESOLUTION OF THE PLANNING COMMISSION OF <br />THE CITY OF SANTA ANA APPROVING VARIANCE NO. <br />2017-07 AS CONDITIONED TO ALLOW THE <br />CONSTRUCTION OF A SIX-STORY 73,322-SQUARE- <br />FOOT HOTEL AND RESTAURANT WITH DEVIATIONS TO <br />PARKING, FRONT SETBACK, WALL HEIGHT AND <br />SIGNAGE FOR THE PROPERTIES LOCATED AT 2115, <br />2123 AND 2129 NORTH MAIN STREET <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF <br />SANTA ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines and declares as follows: <br />A. Net Development Company, hereinafter referred as “Applicant,” is <br />requesting approval of Variance No. 2017-07 as conditioned, to allow the <br />construction of a six-story 73,322-square-foot 135-room hotel and <br />restaurant on 1.9 acres at 2115, 2123 and 2129 North Main Street. <br />B. Pursuant to SAMC Section 41-638, the Planning Commission is <br />authorized to review and approve the following variances for this project <br />to: a) reduce the number of required off-street parking spaces, b) reduce <br />the front setback, c) increase wall heights, and d) increase the number of <br />major building identification signs as set forth by the Santa Ana Municipal <br />Code (SAMC). <br />C. Variance No. 2017-07 came before the Planning Commission of the City <br />of Santa Ana on December 11, 2017, for a duly noticed public hearing. <br />D. The Planning Commission of the City of Santa Ana determines that <br />following findings, which must be established in order to grant Variance <br />No. 2017-07, have been established as required by SAMC Section 41- <br />638: <br />1.That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, the strict application of the zoning ordinance is found <br />to deprive the subject property of privileges not otherwise at <br />variance with the intent and purpose of the provisions of this <br />Chapter. <br />The project site has a special circumstance related to its <br />location and surroundings.
