RESOLUTION NO. 2018-xx <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING VARIANCE NO. 2017-07 AS <br />CONDITIONED TO ALLOW THE CONSTRUCTION OF A <br />SIX -STORY 73,322 -SQUARE -FOOT HOTEL AND <br />RESTAURANT WITH DEVIATIONS TO PARKING, FRONT <br />SETBACK, WALL HEIGHT AND SIGNAGE FOR THE <br />PROPERTIES LOCATED AT 2115, 2123 AND 2129 <br />NORTH MAIN STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. Net Development Company, hereinafter referred to as "Applicant," is <br />requesting approval of Variance No. 2017-07 as conditioned, to allow the <br />construction of a six -story 73,322 square foot 135 -room hotel and <br />restaurant on 1.9 acres at 2115, 2123 and 2129 North Main Street. <br />B. Pursuant to Santa An Municipal Code (SAMC) Section 41-638, the <br />Planning Commission is authorized to review and approve the following <br />variances for this project to: a) reduce the number of required off-street <br />parking spaces, b) reduce the front setback, c) increase wall heights, and <br />d) increase the number of major building identification signs as set forth by <br />the Santa Ana Municipal Code. <br />C. Variance No. 2017-07 came before the Planning Commission of the City <br />of Santa Ana on December 11, 2017, for a duly noticed public hearing. At <br />the December 11, 2017 Planning Commission meeting the Commission <br />continued the item to the January 22, 2018 Planning Commission meeting <br />and asked for more information on the impacts of displaced parking, the <br />southbound Main Street left turn movement into the property, and review <br />of the security measures. <br />D. On January 22, 2018, the Planning Commission discussed the project and <br />made a motion which resulted in a 3:3 vote. In the case of an impasse, <br />pursuant to the Planning Commission Bylaws, the Applicant was offered <br />the option of either continuing the item to a later date for further <br />consideration by the Commission or denial without prejudice to allow the <br />Applicant to appeal the decision to the City Council.
