INSURANCE NOT ON FILE A-2018-419 <br />WORK MAY NOT PROCEED <br />CLERK DE COUNCIL <br />DATE; MAR 16 2018 <br />AGREEMENT TO PROVIDE DRUG AND ALCOHOL <br />TESTING OF CITY EMPLOYERS <br />THIS AGREEMENT is made and entered into this 1614 day of November, 2017 by and <br />between Gary=,Li -a � .D:, ("Consultant! 1, and the City of Santa Ana, a charter city and <br />municipal coipara loll organized and existing under the Constitution and laws of the State of <br />California ("City,') <br />RECITALS <br />A. The City desires to retain a medical consultant having special skill and knowledge and <br />expertise in the field of health services to provide drug and alcohol testing of City <br />employees, both during and after regular business hours, as needed. <br />B. Consultant represents that Consultant is able and willing to provide such services to the <br />City. <br />C. In undertaking the performance of this Agreement, Consultant represents that it is <br />knowledgeable in its field and that any services performed by Consultant under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />a. Consultant shall perform Department of Transportation (DOT) drug and alcohol <br />testing, following DOT -mandated testing procedures as per 49 CFR, Part 40. Such <br />testing shall include: <br />Pre-employment; <br />Fre-assigrunent; <br />Random; <br />Reasonable Suspicion; and <br />Post -Accident <br />b. Consultant shall maintain a current valid contract with a Substance Abuse and Mental <br />Health Services Administration (SAMSl1A) certified laboratory. <br />c. Consultant shall perform non -DOT related reasonable suspicion and post -accident drug <br />and alcohol testing. <br />d. Turn -around time from specimen collection to obtained test results shall be two (2) <br />working days for a negative test, and five (5) working days for a positive test. <br />Page 1 of 9 <br />2$H'3 <br />
