(Ij � i� ��• 1 1E1 ni ...iE., ii mzi u NORTH ELEVATION SOUTH ELEVATION 9 _r --I I II I � oFricE I I r I I I I I 3 The Commission failed to satisfy the 5 required criteria for granting conditional use permits set forth in SAMC Section 41-638 The required findings for Conditional Use Permit No. 2019-30 were made by the Planning Commission The car wash will replace the existing automated car wash at 325 North Tustin Ave. Design provides additional queueing „ Design minimizes exterior noise 9 The Commission erroneously determined that the project was categorically exempt from CEQA as an infill development project The Commission determined that the project was categorically exempt in accordance with the CEQA Guidelines Section 15332, Class 32 (In -fill Development Projects) Consistent with General Plan policies and zoning designation and regulations Site is less than 5 acres and surrounded by urban uses Previously developed site and has no habitat for endangered, rare or threatened species w Served by all required utilities and public services The project will not have a significant effect related to traffic, noise, air quality or water quality as determined by the traffic study, noise study, compliance with SCAQMD regulations and Conceptual WQMP The City Council determines that the project is categorically exempt in accordance with CEQA Guidelines Section 15303, Class 3 (New Construction or Conversion of Small Structures) Development less than 10,000 square feet Does not involves use of hazardous substances W Amendment to Variance No. 2018-10 should have been denied because it does not address "special circumstances" The required findings for amendment to Variance No. 2018- 10 were made by the Planning Commission The findings addressed special circumstances such as: ■ Street dedications Site design and circulation for the proposed use and Irregular shape of the lot (lot width narrows from north to south due to the site being adjacent to an existing freeway) The notice for the September 9, 2019 Planning Commission public hearing was not reasonably calculated to afford affected persons the opportunity to protect their interests Notice of the Planning Commission meeting was provided in accordance with Santa Ana Municipal Code Section 41-636 and Section 2-153(c) and applicable government code notice requirements -Advertised in the Orange County Reporter on August 30, 2019 -Mailed to owners of property and residents within 500 feet of the project site on -Posted on the project site -Email notification to appellant on August 30, 2019 12 Adopt a resolution denying Appeal Application No. 2019-03 and upholding the Planning Commission's approval of Conditional Use Permit No. 2019-30 as amended, amendment to Variance No. 2018-10 as amended, Conditional Use Permit No. 2019-31 as amended and Environmental Review No. 2019-69. 13
