j kwi (7,1,V 1TH .. FIRST AMENDMENT to the above -referenced agreement is entered into on
/ 0 2019, by and between the City of Santa Ana, a -charter city and municipal
corporation organized and existing under the Constitution and laws of the State of California
("City") and RobeitDaniel Walker ("Seller'',
RECITALS
A: The parties entered into Agreement No. A-2016-300, dated October 18, 2016
("Agreement"),., by which :Seller conveyed to City the real property and temporary
construction easement as legally described in the Agreement and exhibits thereto ("Property
Interest"), in connection with City's Bristol Street Widening Project.
B. There are improvements within 'the Property .lnterest, including site improvements
{"Improvements"), that were not compensated under. the Agreement and. for which City now
wishes to compensate Seller.
The Parties therefore agree:
1. Section 6, Paynieat of Purchase Price, is, amended to include the additional amount of one
thousand five hundred dollars ($1,500i00) as payment by City to Seller for the Improvements.
City shall pay this amount by check, and Seller acknowledges ,that this amount is just
compensation for the improvements.
2. Seller further agrees that the Improvements will be removed by City and/or its contractor and
will not be replaced.
3. Except as modified by this First Amendment, all tents and conditions. of the Agreem,ent.shall
remain: in full force and: effect. This First.Amendment. does not affect City's acquisition of; or
compensation for, the rights acquired. under the Agreement.
IN WITNESS WHEREOF, the parties hereto. have executed this First Amendment to the
Agreement, on the:date and year first written above.
