HomeMy WebLinkAboutNS-786ORDINANCE NS-786 AMENDING CHAPTER 1 OF ARTICLE II OF THE SANTA ANA MUNICIPAL CODE REGARDING CITY COUNCIL MEETINGS AND PROCEDURES THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That Chapter 1 of Article II of the Santa Ana Municipal Code is hereby amended to read as follows: ARTICLE II - ADMINISTRATION CHAPTER 1 - CITY COUNCIL SECTION 2100. Council Meetings, Time and Place. Regular meetings of the City Council shall be held on the first and third Monday of each month and shall convene at the hour of 2:00 P.M. At a time determined by the Council it shall recess until 7:30 P.M. of the same day, at which hour it shall reconvene. Council meetings shall be convened in the Council Chambers in the City Hall, Santa Ana, California, and all meetings shall be opened therein, but may adjourn to such other place or places as the Council may order. if, by reason of damage, repair, or alteration of the structure, or other emergency, said place is determined to be unsafe, meetings may be held for the duration of the emergency at such place as may be designated by the Mayor or four members of the Council. SECTION 2100.1. Same. Organization. The newly elected Council shall convene at its first meeting immediately following the adjournment of the prior Council on the first Tuesday after the General Municipal Election at which any member of said Council shall have been elected, or as soon thereafter as the new members have taken their oaths of office. The newly elected Council shall proceed to organize, with the Clerk of the Council acting as chairman thereof, and shall proceed to elect one of its members as Mayor of the City. The newly elected Mayorxshall immediately become the presiding officer. The Council shall thereafter elect a Mayor Pro Tempore. In the absence of the Mayor and the Mayor Pro Tempore, the Clerk of the Council shall call the Council to order and call the roll of the members. If. a quorum is found to be present, the Council shall, by majority vote of those present, elect a chairman of the meeting to act during the meeting or until one of the regularly designated presiding officers shall appear. SECTION 2100.2. Agenda Preparation and Use. Tine Clerk of the Council shall prepare an agenda for each regular meeting of the Council containing all items known by her to be considered by the Council. The order of placing items on the agenda shall be as directed by the Council. All items proposed for the agenda shall be filed with the Clerk of the Council before Wednesday noon preceding each regular meeting and the Clerk shall cause a copy of the agenda, together with information copies of important agenda material, to be delivered to each Councilman at the place designated by him in the City during the Thursday next preceding the regular Council meeting. Copies of the prepared agenda shall be made available to the' members of the public attending the regular Council Meeting by placing the same near the entrance to the place of meeting. SECTION 2100.3. Ordinances and Resolutions. Adoption. When the complete title of a resolution or ordinance has been set forth on the agenda so that any person in attendance may read the same, such inclusion shall be considered as having the same effect as though the title of the resolution or ordinance had been read aloud at the regular meeting at the time the resolution or ordinance was being considered for adoption. When two or more ordinances are being considered to be passed to second reading or are being considered for adoption, or when two or more resolutions are being considered for adoption, such action, in any one of said three situations, may be taken by one roll call vote and said vote shall be deemed to have been given to each ordinance or resolution in that particular group as though it had been voted upon individually. Whenever a motion is made to pass two or more ordinances to second reading or to adopt two or more ordinances or resolutions, which motion provides that the vote thereon shall be deemed to have been given to each ordinance or resolution as though the same had been voted upon individually, any member of the Council may request that one or more of the resolutions or ordinances be dropped from the motion to be considered by the Council individu- ally, and such a request shall be deemed a matter of right. In such a case, the motion shall be withdrawn_ by the mover and a new motion may be made for such group consideration which must omit each ordinance or resolution regarding which such a request has been made. SECTION 2100.4. Rules of Order. Unless a provision to the contrary is contained in the Charter of the City of Santa Ana or this Code, procedures before the Council shall be governed by "PARLIAMENTARY PROCEDURE AT A GLANCE" by 0. Garfield Jones,.published by Appleton -Century, New York, which is an abbreviated form of Robert's Ruleslof Order. In case of any dispute or doubt, "ROBERT'S RULES OF ORDER REVISED, Seventy -Fifth Anniversary Edition" shall control. SECTION 2101. Decorum and Order. The presiding officer shall preserve decorum and shall decide all questions of order, subject to appeal to the Council. (a) Council members shall preserve decorum and observe an orderly procedure. Every councilman desiring to speak shall address the chair and upon being recognized by the presiding officer shall confine himself to the questions under debate. A councilman, once recognized, should not be interrupted while speaking unless a point of order is raised by another member. No councilman shall speak more than three (3) minutes on any one subject and, having spoken, may.not speak again_ until all other councilmen who wish to be heard have spoken, and no member shall speak more than twice on any subject unless authorized by the Council so to do. (b) W�sen any group desires to address the Council its members should agree on a spokesman, to make the presentation. Any such spokesman or any individual desiring to address the . Council shall step to the microphone, state his name and residence address, and direct his remarks to the Council as a body and not to any individual member thereof. No person other than members of the Council and the person having the floor may be permitted to enter into the discus- sion without permission of the presiding officer. No person addressing the Council shall speak more than five (5) minutes on any subject. (c) By a majority vote of the Council the time limit in (a) and the time limit in (b) may be extended for a period of time certain and expressed in a motion so that a more detailed presentation can be made when desired. -2- (d) The Council may declare a period set aside for presentation of data to them by the City Manager, department heads, and/or other persons called before them to report or answer questions. When such a period is declared the time limit on the presentation or report may be waived. The conduct of such session shall be under the control of the presiding officer and no debate or argument shall be tolerated unless authorized by the presiding officer of the Council. Persons other than those herein named, unless called upon by the Council or the presiding officer, shall not be heard during such sessions. (e) The presiding officer shall have the duty of maintaining order at all times and may direct that any person disturbing the meeting, speaking without permission, or otherwise acting in a disorderly manner, be removed from the place of meeting, and any peace officer present shall carry out such order. No person shall violate the order and decorum of. a Council Meeting, speak without permission, or do any- thing which may interfere with the quiet deliberation of the Council. Any violation of this provision is declared to be a misdemeanor and any person violating the same may be prosecuted on a complaint signed by the presiding officer or any person acting under his direction. Any peace officer present in the Council Chambers or place of meeting shall arrest any person violating this provision if ordered so to do by the presiding officer or by a vote of the Council. SECTION 2102. Councilmen Voting. No member of the Council shall abstain_ from any vote unless disqualified, and no disqualified member shall vote. Any disqualified member shall openly state to the presiding officer the fact and nature of such disqualification and shall not be subject to further inquiry. Where no clearly disqualifying conflict of interest appears, the matter of disqualification may, at the request of the member affected, be decided by the other members of the Council. A member disqualified by conflict of interest shall request and be granted permission by the presiding officer to absent himself from the room where the Council is meeting during debate and vote on the matter. Any member having a remote interest in any matter shall divulge the same to the Council before voting. SECTION 2: That Sections 2103., 2104., and 2105. of the Santa Ana Municipal Code are hereby repealed. SECTION 3: That this Ordinance shall take effect thirty days from and after the date of its adoption.
