RECOMMENDED ACTION
1. Approve an appropriation adjustment recognizing $935,000 in Fiscal Year 2018-19 Congestion
Mitigation and Air Quality (CMAQ) construction funds in the Select Street Construction, Federal
Grant -Indirect revenue account and reappropriating the same amount in Fiscal Year 2019-20
Select Street Construction, Improvements Other Than Building expenditure account.
2. Authorize reallocation of $18,000 in unspent Measure M2 Local Fairshare funds from the Bike
Lane Development Project (No. 19-6904) to the Hazard Avenue Protected and Class II Bike
Lanes Project (No. 18-6903), to fulfill the City matching funds requirement.
3. Award a construction contract to HYM Engineering, Inc., the lowest responsible bidder, in
accordance with the base bid in the amount of $882,919, for construction of Hazard Avenue
Bike Lanes Project, for the term beginning on May 5, 2020 and ending upon project completion,
and authorize the City Manager to execute the contract subject to non -substantive changes
approved by the City Manager and the City Attorney
4. Approve the Project Cost Analysis for a total estimated construction delivery cost of $1,081,000,
which includes $882,919 for the construction contract; $109,741 for contract administration,
inspection and testing; and a $88,340 project contingency for unanticipated or unforeseen work.
DISCUSSION
On August 8, 2016, the Orange County Transportation Authority Board of Directors approved a list
of recommended projects to be funded by the 2016 Bicycle Corridor Improvement Program (BCIP)
recommended projects, which included $1,035,000 for the Hazard Avenue Bike Lanes project.
This project will install 0.65 miles of protected bike lanes and 0.45 miles of Class III bike route on

Hazard Avenue from Euclid Avenue to Harbor Boulevard (Exhibit 1). This bicycle corridor passes
through a mix of land uses, such as residential, schools, and parks.
Grant funds in the amount of $100,000 were recognized in the Fiscal Year 2017-18 Capital
Improvement Program (CIP), which were used for Preliminary Engineering (Design) in FY 2017-
18, and $935,000 was recognized in the Fiscal Year 2018-19 CIP for Construction. However,
spending authorization for the $935,000 in Construction funding was not received until August
2019. Staff is requesting City Council approval to recognize and reappropriate this grant allocation
for expenditure in Fiscal Year 2019-20 to complete the bike lane project.
Staff also seeks approval for the reallocation of $18,000 of Measure M2 Local Fairshare funds to
meet the matching funds requirement of $146,000. Upon approval of the requested appropriation
adjustment and reallocation, the total funds available for construction will be $1,081,000, which is
comprised of $935,000 in grant funds, and $146,000 in the required local match.
Public Outreach and Contractor Participation
To provide an opportunity for local vendors to submit bids, a Notice Inviting Bids was advertised in
the Orange County Register newspaper on February 5 and February 12, 2020. The project was
also advertised in PlanetBids from February 5, 2020 through February 26, 2020. Bids were
received electronically via PlanetBids, on February 26, 2020.
A total of 382 vendors, including vendors in the City of Santa Ana, were notified of the project via
PlanetBids. Thirty vendors requested bidding documents and two bids were received. No bids
were received from Santa Ana contractors.

Both bids were responsive with HYM Engineering, Inc. submitting the lowest responsible bid in the
amount of $882,919 (Exhibit 2). Based on the bid analysis and a contractor's reference check, staff
recommends awarding the construction contract to HYM Engineering, Inc. in the amount of
$882,919 (Exhibit 3).
Project Delivery
To deliver a complete project, in addition to the construction contract, the estimated total project
delivery cost includes construction administration, inspection, and testing, along with an allowance
for contingencies to account for unexpected or unforeseen conditions. Construction administration
and inspection includes construction management; implementation of the City's Community
Workforce Agreement requirements; inspection of the Contractor's work to ensure contract
compliance, workmanship, and quality; and material testing. As indicated in the Cost Analysis

the project is $1,081,000.

STRATEGIC PLAN ALIGNMENT
Approval of this item supports the City's efforts to meet Goal #6 - Community Facilities &
Infrastructure, Objective #1 (establish and maintain a Community Investment Plan for all City
assets), Strategy B (equitably maintain existing streets and associated assets in a state of good
repair so they are clean, safe, and aesthetically pleasing for all users), and Strategy G (develop
and implement the City's Capital Improvement Program in coordination with the Community
Investment Plan (e.g., neighborhood streets, traffic improvements, park facilities, bike master plan,
etc.)).
ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act, the recommended actions are exempt
from further review. Categorical Exemption Environmental Review No. 2016-36 was filed for this
project.
FISCAL IMPACT
As indicated in the Cost Analysis (Exhibit 4), the estimated total delivery cost of this project is
$1,081,000, which includes construction contract, contract administration, inspection and testing,
and project contingency. Approval of the Appropriation Adjustment will recognize $935,000 in
Fiscal Year 2018-19 Congestion Mitigation and Air Quality (CMAQ) construction funds in the Select
Street Construction, Federal Grant -Indirect revenue account (No. 05917002-52001) and
reappropriate the same amount into the Select Street Construction, Improvements Other Than
Building expenditure account (No. 05917660-66220). The reallocation of $18,000 in unspent
Fiscal Year 2018-19 Measure M2 Local Fairshare funds will be available to fully fund the City's
$146,000 matching funds requirement.

TIME FOR COMPLETION OF IMPROVEMENTS AND LIQUIDATED DAMAGES

Proceed.
The liquidated damages amount, in lieu of the amount specified in Subsection 6-9 of the Standard

BIDDER'S STATEMENT
BIDDER understands and agrees that this Bid Proposal, Contract Documents and subsequent
Construction Contract Agreement shall constitute the entire agreement between BIDDER and the
AGENCY only after it has been accepted by the City Council, endorsed by the Clerk of the Council
with her signature and official seal noting hereon the action of approval of the Council, signed by
the Public Works Agency Executive Director or his/her duly authorized agent, and signed by the
City Attorney, denoting his approval of the form of this document, and its execution, and when it
or an exact copy of it has been either delivered to BIDDER or deposited with the United States
Postal Service properly addressed to the BIDDER with the correct postage affixed thereto.
BIDDER further agrees that upon delivery (as defined above) of the accepted agreement he/she
will furnish AGENCY all required bonds and certificate of liability insurance within ten (10)
business days or the funds, check, draft, or BIDDERS bond substituted in lieu thereof
accompanying this proposal shall become the property of the AGENCY and shall be considered
as payment of damages due to the delay and other causes suffered by AGENCY because of the
failure to furnish the necessary bonds and because it is distinctly agreed that the proof of damages
actually suffered is difficult to ascertain; otherwise said funds, check, drafts, or BIDDER'S bond
substituted in lieu thereof shall be returned to the undersigned.
BIDDER understands that a bid is required for the entire work, the estimated quantities set forth
in the bid schedule are solely for the purpose of comparing bids, and that final compensation under
the contract will be based upon the actual quantities of work satisfactorily completed. The
BIDDER also certifies that the bid is a balanced bid.

PREVAILING WAGE COMPLIANCE AND MONITORING STATEMENT
Contractor is aware of the requirements of California Labor Code Section 1720, et seq., as well as
California Code of Regulations, Title 8, Section 16,000, et seq., ("Prevailing Wage Laws"), which
require the payment of prevailing wage rates and the performance of other requirements on "public
works" and "maintenance" projects. Since the services are being performed as part of an applicable
"public works" or "maintenance" project, as defined by the Prevailing Wage Laws, and since the
total compensation is $1,000 or more, Contractor agrees to fully comply with such Prevailing
Wage Laws.
City shall provide Contractor with a copy of the prevailing rates of per diem wages in effect at the
commencement of this Agreement. Contractor shall make copies of the prevailing rates of per
diem wages for each craft, classification or type of worker needed to execute the services available
to interested parties upon request, and shall post copies at the Contractor's principal place of
business and at the project site.
Contractor shall defend, indemnify and hold the City, its elected officials, officers, employees and
agents free and harmless from any claim or liability arising out of any failure or alleged failure to
comply with the Prevailing Wage Laws.

NON-DISCRIMINATION CERTIFICATE
The undersigned contractor or corporate officer, during the performance of this contract, certifies
as follows:
The Contractor shall not discriminate against any employee or applicant for employment

performing this work. No extra work or additional work will be performed without written authorization.

-TLC will not be impacted by Liquidated Damages assessed by the Contractor / Agency due to an inadequate amount of time to complete TLC operations.

TLC no later than 10 calendar days after the Contractor receives payment from Owner for our completed work.
-Retention % is to be withheld only as per the Owner's requirements.
-Contractor hereby agrees that time shall be of the essence In regard to all payments provided for herein, and if any payment is not made when due, Contractor
agrees to pay all collection costs and expenses including costs of suit and any related attorney's fees and costs and also hereby waives the benefit of any statute of
limitation that would prohibit an action of TLC to enforce the terms and conditions of this Contract including but not limited to any right to
recovery of attorneys fees and costs. The laws of the State of California shall control all aspects of this contract except as to lien matters, which will be governed by
the laws of the state where the subject property is located.

The undersigned, is submitting this proposal for performing by contract the work required by these
bid documents, certify to comply with the following:
The agency shall hold retainage from the prime contractor and shall make prompt and
regular incremental acceptances of portions, as determined by the agency, of the contract
work, and pay retainage to the prime contractor based on these acceptances. The prime
contractor, or subcontractor, shall return all monies withheld in retention from a
subcontractor within 30 days after receiving payment for work satisfactorily completed
and accepted including incremental acceptances of portions of the contract work by the
agency. Federal law (49CFR26.29) requires that any delay or postponement of payment
over 30 days may take place only for good cause and with the agency's prior written
approval. Any violation of this provision shall subject the violating prime contractor or
subcontractor to the penalties, sanctions and other remedies specified in Section 7108.5
of the Business and Professions Code. These requirements shall not be construed to limit
or impair any contractual, administrative, or judicial remedies otherwise available to the
prime contractor or subcontractor in the event of a dispute involving late payment or

This CONSTRUCTION CONTRACT is made and entered into this 5s' day of May, 2020 by and
between the City of Santa Ana, California, a charter city and municipal corporation organized and
existing under the Constitution and laws of the State of California (hereinafter "CITY"), and HYM
Engineering, Inc. (hereinafter "CONTRACTOR").
WH`NESSETH:
The CITY and the CONTRACTOR, for the consideration hereinafter named, mutually agree as follows:
1. CONTRACTOR agrees to perform all the work and furnish all the materials at its own cost and
expense necessary to construct and complete in a good and workmanlike manner and to the
satisfaction of the City Engineer of the CITY, the Hazard Avenue Protected Bike Lanes from Euclid
Street to Harbor Blvd Project (hereinafter referred to as the "WORK OF IMPROVEMENT")
identified in and in accordance with the Contract Documents prepared by the City's Public Works
Agency and approved by the City Council.
2. The complete Construction Contract consists of the "Contract Documents" as defined by the
Standard Specifications for Public Works Construction and which include the following:
• Notice Inviting Bids
• Information to Bidders
• Bid Proposal
• Bid Bond
• Contract Form
• Contract Bonds
• General Provisions
• Special Provisions
• Technical Provisions and Project Plans
• Community Workforce Agreement

In case of conflict between the Contract Documents, the precedence of documents shall be as
established in the Standard Specifications for Public Works Construction.
3. CITY agrees to pay and CONTRACTOR agrees to accept in full payment to complete the WORK
OF IMPROVEMENT the sum total amount not to exceed Eight Hundred Eighty-two Thousand Nine
Hundred Nineteen Dollars and No Cents ($882,919.00), as set forth and identified in the BID
PROPOSAL, which is attached hereto and incorporated herein as Exhibit "A."

The BID PROPOSAL contains a schedule of unit price(s) or lump sum(s) based on approximate
quantities only, and the City does not expressly or by implication agree that the actual amount of
work will correspond therewith, but reserves the right to increase or decrease the amount of any
class or portion of the work or to omit portions of the work as may be deemed necessary or
advisable.
4. CONTRACTOR agrees to complete the WORK OF IMPROVEMENT within the time specified in
the Time for Completion of Improvements section of the BID PROPOSAL (Exhibit "A") including
commencing construction within the timeframe therein specified after issuance of a Notice to
Proceed.
5. The CONTRACTOR will pay, and will require all subcontractors to pay, all employees on the
WORK OF IMPROVEMENT a salary or wage at least equal to the prevailing salary or wage
established for such work as set forth in the wage determinations for this work in accordance with
applicable State and Federal law.
6. If applicable, the CONTRACTOR shall adhere to the CITY'S Community Workforce Agreement
(CWA), a pre -hire collective bargaining agreement, which establishes the labor relations policies and
procedures for CONTRACTOR to follow in the crafts persons employed to complete the WORK OF
IMPROVEMENT as more fully described in the CWA. The CWA may be found on the City's

7. CONTRACTOR shall, after award of this Contract, furnish two bonds to be approved by the CITY,
one in the amount of One Hundred Percent (100%) of the Contract price, to guarantee the faithful
performance of the work (Performance Bond), and one in the amount of One Hundred Percent
(100%) of the Contract price to guarantee payment of all claims for labor and materials furnished
(Payment Bond). This Contract shall not become effective until such bonds are supplied to and
approved by the CITY.
8. CONTRACTOR shall, prior to the release of the performance and payment bonds or the retention
payment, furnish a warranty performance and payment bond (Warranty Bond). Said Warranty Bond
shall also be required as a condition of project acceptance. For projects up to Five Hundred
Thousand Dollars ($500,000), the Warranty Bond amount shall be the greater of Ten Thousand
Dollars ($10,000) or Twenty Percent (20%) of the final contract price. For projects above Five
Hundred Thousand Dollars ($500,000), the Warranty Bond amount shall be the greater of One
Hundred Thousand Dollars ($100,000) or Ten Percent (10%) of the final contract price.
9. CONTRACTOR shall, after award of this Contract, furnish Certificates of Liability Insurance and
Worker's Compensation Insurance as outlined in the General Provisions, to be approved by the
CITY.
