No further public comments will be heard at the June 18, 2020 City Council meeting. 75A-1. PUBLIC HEARING - TO CONSIDER ORDINANCE NS-XXXX TO ADOPT THE FISCAL YEAR 2020-21 BUDGET, RESOLUTION NO. 2020-XXX TO APPROVE CHANGES TO THE CITY'S BASIC CLASSIFICATION AND COMPENSATION PLAN, ADOPT THE FIVE-YEAR STRATEGIC PLAN AND THE SEVEN-YEAR CAPITAL IMPROVEMENT PLAN - Finance and Management Services Agency - Legal Notice published in the Orange County Reporter on June 5, 2020 and June 12, 2020. 1. Place ordinance on first reading and authorize publication of title. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTA ANA APPROPRIATING MONIES TO THE SEVERAL OFFICES, AGENCIES, AND DEPARTMENTS OF THE CITY FOR FISCAL YEAR BUDGET PERIOD COMMENCING JULY 1, 2020 2. Adopt a resolution. RESOLUTION NO. 2020-XXX – A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA TO AMEND CITY COUNCIL MINUTES 1 JUNE 18, 2020 RESOLUTION NO. 2015-026 TO EFFECT CERTAIN CHANGES TO THE CITY’S BASIC CLASSIFICATION AND COMPENSATION PLAN. 3. Adopt the City of Santa Ana FY 2020-21 to FY 2024-25 Strategic Plan. 4. Adopt the Seven-Year Capital Improvement Program (CIP) beginning FY20- 21 through FY26-27, as required by the Orange County Transportation Authority (OCTA) for Measure M2 eligibility. Public hearing on the budget was opened and closed at the Regular meeting of June 16, 2020. Council Discussion ensued and direction provided to city staff. Councilmember Solorio clarified motion to approve to approve amended actions captured by City Manager Kristine Ridge the direction pointes of each department and that staff return with their best effort at accommodating those recommendations from the Council with staff report and/or presentation for the July 7, 2020 Council meeting with non-substantial changes. Approve a $22,612,766 pre-payment for the City’s annual Unfunded Actuarial Liability to California Public Employees Retirement System (CalPERS) – Miscellaneous Plan for Fiscal Year 2020-21, to save $778,061. 2. Approve a $25,351,433 pre-payment for the City’s annual Unfunded Actuarial Liability to California Public Employees Retirement System (CalPERS) – Safety Plan for Fiscal Year 2020-21, to save $872,293. PUBLIC HEARING - ADOPT A RESOLUTION FOR A MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING AND REPORTING PROGRAM FOR THE FAIRVIEW BRIDGE REPLACEMENT AND STREET IMPROVEMENTS FROM 9TH STREET TO 16TH STREET (PROJECT NO. 15- 6827) (NON-GENERAL FUND) - Public Works Agency - Legal Notice published in the Orange County Reporter on June 5, 2020 and notices mailed on said date. 1. Adopt a resolution. RESOLUTION NO. 2020-XXX - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ADOPTING THE MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING AND REPORTING PROGRAM FOR THE FAIRVIEW BRIDGE REPLACEMENT AND STREET IMPROVEMENTS (9TH STREET TO 16TH STREET) PROJECT 2. Approve the Fairview Bridge Replacement and Street Improvements from 9th Street to 16th Street Project. Executive Director of Public Works Agency Nabil Saba provided a brief presentation. Mayor Pulido opened the public hearing at 7:58 p.m. PUBLIC COMMENTS Kristopher Fortin with Santa Ana Active Streets spoke in opposition to Item 75B and noted safety concerns for bicyclists and pedestrians. Kelly Crowsley spoke in opposition to the item due to a lack of a protective bike lane. CITY COUNCIL MINUTES 3 JUNE 18, 2020 Mayor Pulido closed the Public Hearing at 8:03 p.m. Council discussion ensued and direction provided to staff. Motion to Adopt as amended to include 3 and 4 indicated below: 1. Adopt a resolution. RESOLUTION NO. 2020-054 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA ADOPTING THE MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING AND REPORTING PROGRAM FOR THE FAIRVIEW BRIDGE REPLACEMENT AND STREET IMPROVEMENTS (9TH STREET TO 16TH STREET) PROJECT 2. Approve the Fairview Bridge Replacement and Street Improvements from 9th Street to 16th Street Project. 3. Incorporate protected bike lanes on both the North and South side of the bridge. 4. Consider community input on the aesthetics of the bridge. DISCUSS AND CONSIDER DIRECTING THE CITY MANAGER TO DIRECT STAFF TO RESEARCH THE CREATION OF A POLICE OVERSIGHT COMMISSION BY ORDINANCE AND PRESENT FINDINGS TO THE CITY COUNCIL WITHIN 90 DAYS – Councilmembers Bacerra, Penaloza and Sarmiento Clerk of the Council Gomez reported out on eComments received. PUBLIC COMMENTS: CITY COUNCIL MINUTES 4 JUNE 18, 2020 Kelly Crowsley spoke in support of creating an effective commission. Jennifer Rojas, with the American Civil Liberties Union, spoke in support of Item 85A, requests the committee be established in partnership with community organization, and spoke on various other topics. Dan Escamilla spoke in support of an oversight committee and various other items. Thai Phan spoke in support of a police oversight committee, a reallocation of internal affairs duties and various other topics. Roberto spoke regarding Santa Ana Police Department response times and access to police data. Tanya Navarro spoke in support of a police oversight committee with various powers. Council discussion ensued and direction provided to city staff to research the most update to date, best practices, and various models of oversight commissions to be brought back to council in 90 days, September 15, 2020. CITY COUNCIL MINUTES 6 JUNE 18, 2020 Cecilia Iglesias spoke in support of a police oversight committee with subpoena power and various other topics. Katie spoke in support of Item 85A. Rosa spoke in opposition to item 85A. Ana Ursua spoke in support of an oversight committee with subpoena and oversight powers and various other topics. Katie Mondragon spoke in support of an oversight committee and various other topics. Council discussion and direction to staff continued. Councilmember Sarmiento, noted the lack of trust in the community that needs to be addressed to create a balance and directed staff to present to council with options of the various committees in other cities. Councilmember Solorio, asked staff, colleagues, and the community to consider new ideas and approaches, results to improve community safety overall and create a culture of non-violence and kindness. Directed staff to consider the 10 largest cities, the type of powers each has, number of members, appointers, cost to administer program, and where in the organization it sits. Councilmember Mendoza, expressed support in exploring an oversight commission and inquired about existing disciplinary actions, policy and laws at the state and federal level, and reform propositions from the governor and presidential administration. Directed staff to include a clear understanding of civilian qualifications, costs to employ or to compensate board members, and indicate pro and cons of giving the powers of a subpoena. Mayor Pro Tem Villegas in support of exploring an oversight committee. Mayor Pulido expressed support to find areas of improvements to be applied to many areas. 85B. DISCUSS AND CONSIDER DIRECTING THE CITY MANAGER TO PROVIDE $1.5 MILLION TO SANTA ANA UNIFIED SCHOOL DISTRICT TO FUND 2020 SUMMER AND FALL PROGRAMS (E.G., ETHNIC STUDIES AND THE NON- VIOLENCE MOVEMENT, INTERACTIVE STEAM ONLINE EDUCATION, STUDENT LEADERSHIP AND PUBLIC SPEAKING, OPEN-AIR ARTS PROGRAMS, AND TECHNOLOGY ACCESS PROGRAMS), AS WELL AS BRING BACK FOR COUNCIL CONSIDERATION WITHIN 45 DAYS FINAL RECOMMENDATIONS FROM OUR YOUTH COMMISSION TO ALLOCATE ANOTHER $1.5 MILLION OR MORE OF THIS FISCAL YEAR’S ALLOCATION CITY COUNCIL MINUTES 7 JUNE 18, 2020 FROM THE YOUTH FUND. WHEN FEASIBLE, FUNDED PROGRAMS SHOULD BE MADE AVAILABLE CITYWIDE FOR ALL YOUTH IN OUR CITY – Councilmembers Mendoza, Solorio and Villegas Council discussion ensued and direction provided to staff. Councilmember Solorio requested to revise his request, due to the recent changes, to direct staff to bring back for council consideration within 45-days final recommendations for use of the entire $6 - $7 million in the youth fund that is funded by the Cannabis Fund that will be available as of July 1, 2020. In addition, requests city departments, the City Zoo, Santa Ana Unified School District, the Discovery Cube and Santa Ana based non-profits submit proposals to fund 2020 summer and fall programs. Councilmember Solorio made brief statements on behalf of Youth Commission Chair Joseph Acevedo. Mayor Pro Tem spoke regarding childcare. PUBLIC COMMENTS Thai Phan spoke in support of youth programs. Gerry Almendariz, Superintendent with Santa Ana Unified School District, spoke in support of Item 85B for summer programs and spoke on various other topics. Dulce strongly believes in investing in youth and supports ethnic studies and non- violent movements. Spoke regarding Youth Commission meetings and various other topics. Kathy Decker, Executive Director for the Friends of Santa Ana Zoo, spoke regarding the Santa Ana Zoo and redirecting youth funds for its educational programs. Steve Gallegos spoke in support of investment in youth, however, expressed concern with the recommended programs. Selena Gallegos spoke in support of item. Speaker spoke in support of item. Magdalena Sorria spoke in support of item and various other topics. Cecilia Iglesias spoke in opposition of the item, and stated funds should be put towards other City services and spoke on various other topics. CITY COUNCIL MINUTES 8 JUNE 18, 2020 Julie Gallegos spoke in support of investing in the youth, however, requests more details. Idalia Rios spoke in support of the item and hopes that both the City and the School District collaborate for the benefit of all. Council discussion continued at the end of public comments and additional direction provided to city staff. Councilmember Penaloza expressed concern and opposition to item 85B. Councilmember Bacerra expressed concern and opposed item 85B. Executive Director of Parks, Recreation, and Community Agency Lisa Rudloff spoke. Mayor Pro Tem Villegas spoke in support of the plan provided by Executive Director of Parks, Recreation, and Community Agency Lisa Rudloff outlined in her 2019 memo along with redeploying the part-timers. Councilmember Bacerra clarified that the code does not require the Youth Commission ratify a list before proceeding with the implementation of programs. Councilmember Sarmiento clarified that the cannabis funds are restricted for youth expenditures and youth programing. Expressed support of opinions from all school districts, however, city staff, in particular Executive Director of Parks, Recreation, and Community Agency Lisa Rudloff, have given a lot of thought of how the city should expend these monies and the city has an obligation and role to deliver youth services. In addition, requested that funds be provided direction to include WiFi access to benefit youth and residents. Councilmember Penaloza, spoke on the need to provide WiFi access to the community. Councilmember Mendoza, reported that Santa Ana Unified School District purchased hotspots and urged the city to collaborate with Santa Ana Unified School District. Councilmember Penaloza, spoke on working on a partnership with the Santa Ana Unified School District. Mayor Pulido, believes there is a middle ground, is supportive of monies to stay with the city to do more for youth and directed city manager to bring back ideas, talk with councilmembers regarding wish list and return to council to move forward with youth services. DISCUSS AND CONSIDER DIRECTING THE CITY MANAGER TO DIRECT STAFF AS APPROPRIATE, TO PROVIDE PUBLIC EDUCATION, FINE-BASED ENFORCEMENT AND PREVENTION SERVICES RELATED TO THE USE OF ILLEGAL FIREWORKS THROUGH REMAINDER OF JUNE AND JULY THIS YEAR - Councilmember Solorio Councilmember Solorio provided direction to city staff. PUBLIC COMMENTS Steve Gallegos spoke in support of mitigation plan, but in opposition of imposing a $1,000 fine. Carla Juarez spoke regarding Item 85B, urges council to invest in youth services and various other topics. Lisa Gonzalez-Solomon spoke in support of collaboration between the city and all school districts to fund youth programs. Clerk of the Council reported out electronic comments received. PUBLIC COMMENTS Olga spoke regarding the public comment process, expressed support of a police oversight committee and spoke on various other topics. 90A. CITY MANAGER’S COMMENTS None. 90B. CITY COUNCILMEMBER COMMENTS Councilmember Solorio expressed appreciation towards City staff and reminded the community that masks are recommended to help stop the spread of COVID- 19. Councilmember Penaloza expressed appreciation towards city staff and wished everyone a Happy Father's Day. Councilmember Mendoza expressed appreciation towards City staff. Councilmember Sarmiento expressed appreciation towards staff, council and the public. Provided an update on recent events. Councilmember Bacerra provided community announcements. CITY COUNCIL MINUTES 10 JUNE 18, 2020 Mayor Pro Tem Villegas wished everyone a Happy 4th of July and a Happy Father’s Day. Mayor Pulido provided an update on the possible COVID-19 CARES Act funding, the importance of wearing masks on public transportation, wished everyone a Happy Father's Day, and spoke on various other topics.
