Ordinance Prohibiting Repair and Sale of Bicycles on Public PropertyCity Manager’s OfficeNovember 17, 2020Slide 3• At the October 20, 2020 meeting, the City Council discussed an agenda item relating to a prohibition of the repair and sale of bicycles and bicycle parts on public property in Santa Ana. • The item was introduced based on an increase of reported bicycle thefts in Santa Ana, with many of these bicycles then being dismantled and sold on public property. • In order to address the illegal activity, staff recommends that the City Council consider an ordinance prohibiting the repair and sale of bicycles and bicycle parts on public property.

Ordinance Prohibiting Repair and Sale of Bicycles on Public PropertyCity Manager’s OfficeNovember 17, 2020Slide 5• The proposed ordinance would prohibit the assembly, disassembly, sale, offer of sale, distribution, offer of distribution, or storage of the following items on any street, sidewalk, alley, public passageway, public right-of-way, public park, or other public property within the City:– Three (3) or more bicycles– A bicycle frame with the gear cables or brake cables that are inoperable, cut, or missing– Two (2) or more bicycles with missing parts– Five (5) or more bicycle parts
Ordinance Prohibiting Repair and Sale of Bicycles on Public PropertyCity Manager’s OfficeNovember 17, 2020Slide 6• These prohibitions would not apply under the following circumstances:– When an individual is operating under a valid City of Santa Ana license or permit authorizing such activities– When the owner of a bicycle or bicycle part is present during the repair of the owner’s single bicycle or bicycle part. • Violations would be deemed to be a misdemeanor and would be punishable as provided for in the Santa Ana Municipal Code, such as by administrative citation.
