J"7 I TO PURCHASE TAX -DEFAULTED PROPERTY This Agreement is made this 1S day of Qb PV' , 20� L, by and between the County of Orange, a political subdivision of the State of California ("County"), and the City of Santa Ana ("Purchaser"), pursuant to the provisions of Division 1, Part 6, Chapter 8, of the Revenue and Taxation I Code. RECITALS WHEREAS, the real property situated within County, described in Exhibit A to this Agreement has been tax -defaulted for five (5) years or more and is subject to the power to sale by the Treasurer -Tax Collector of said County for the nonpayment of taxes, pursuant to provisions of law; and WHEREAS, the property is located in City of Santa Ana; and WHEREAS, Purchaser needs the property for street and highway purposes and intends to devote the property to said purposes after this Agreement becomes effective; ARTICLES It is mutually agreed as follows: 1. Purchaser, agrees to pay the sum of 14$ ,700,00 for the property within 45 days after the date this Agreement becomes effective. Upon payment of said sum to the Treasurer -Tax Collector, the Treasurer -Tax Collector shall execute and deliver a deed conveying title to the property to Purchaser. 2. As provided by Section 3800 of the Revenue and Taxation Code, the cost of giving notice of this Agreement shall by paid by Purchaser, 3. As provided by Section 3808 of the Revenue and Taxation Code, the amount of the purchase price paid pursuant to this Agreement to the Orange County Treasurer -Tax Collector shall be deposited, like tax collections, in the delinquent sale trust fund and shall be distributed pursuant to Section 4671 et seq. of the Revenue and Taxation Code. 1 2 3 4 5 6 7 8 9 10 it 12 13 14 15 16 17 20 21 22 23 24 25 26 27 28 4. This Agreement shall become effective on a date determined by the Treasurer -Tax Collector, but no sooner than 5:01 p.m. on the 2151 day after the first publication of the Notice of Agreement. 5. If all or any portion of any individual parcel listed in Exhibit "A" is redeemed prior to the effective date of the Agreement, this Agreement shall be null and void as to that individual parcel. This Agreement shall also become null and void and the right of redemption restored upon the Purchaser's failure to comply with the terms and conditions of this Agreement. 6. This Agreement, when accepted by Purchaser either in writing or commencement of performance hereunder, contains the entire Agreement between the parties with respect to the matters herein and there are no restrictions, promises, warranties or undertakings other than those set forth herein or referred to herein. 7. Purchaser acknowledges that it has read and agrees to all terms and conditions included in this Agreement. 8. The parties to the Agreement represent and warrant that this Agreement has been duly authorized and executed and constitutes the legally binding obligation of their respective organization or entity, enforceable in accordance with its terms.
