TEMPORARY CONSTRUCTION EASEMENT DEED
FOR VALUABLE CONSIDERATION, receipt of which Is hereby acknowledged,
VWliz Investment, LLC ("Grantor")
Does Hereby Grant to the CITY OF SANTA ANA, a charter City and municipal corporation duly organized
under the Constitution and laws of the State of California ("Grantee").
A Temporary Construction Easement over that real property in the City of Santa Ana, Orange County,
State of California described In Exhibit "A" and shown in Exhibit "B" (the "Servient Tenement"), which
exhibits are attached hereto and by this reference made a part hereof. The temporary construction
easement granted herein shall terminate on completion of the construction work, consisting of
Improvements to a public thoroughfare located on Warner Avenue in the City of Santa Ana, for a
term not to exceed six (6) months from the date of execution of this Temporary Construction
Easement Deed.
The easement granted herein is a temporary right to enter upon the Servient Tenement to cross
over the Servient Tenement in connection with the performance of certain construction work on
Warner Avenue, situated adjacent to the Servient Tenement. At all times, Grantee shall not engage
In any conduct which denies access to the Servient Tenement nor causes the Interruption of utility
services, Including but not limited to, water, sewer, gas, electrical and telephone to the Servient
Tenement. Grantee shall not impede access for tenants at location and shall not allow storage of
equipment or materials on the property throughout the term of the Temporary Construction
Easement.
Within fifteen .(15) days following completion of the construction work, Grantee shall repair any
and all damage It caused to the Servient Tenement.
Grantee shall hire only licensed contractors who carry workers compensation Insurance and
liability coverage for personal Injury and property damage. Furthermore, Grantee shall not cause
to be recorded any Mechanic's Liens on Grantor's property. Grantee shall Indemnify, defend, and
hold harmless, the Grantor and Grantor's members, managers, agents, tenants, successors,
heirs, and assigns for any and all claims arising from Grantee's use of the Sorvient Tenement.

pursuant to authority conferred by Ordinance No. NS-2352 and Section No. 33-55
of the Santa Ana Municipal Code adopted by the City Council on June 1, 1988, in
the compliance with California Government Code Section 27281 and the grantee
consents to recordation thereof by its duly authorized officer.
