AGREEMENT BETWEEN THE CITY OF SANTA
ANA AND THE SANTA ANA HISTORICAL
PRESERVATION SOCIETY TO PROVIDE FIRE
PROTECTION TO THE HOWE-WAFFLE HOUSE
THIS AGREEMENT, made and entered into this 9th day

of e'r , by and between the City of Santa Ana, a
municipal corporation of the State of California, hereinafter
referred to as the "CITY", and the Santa Ana Historical Preserva-
tion Society, a nonprofit corporation of the State of California,
hereinafter referred to as "SOCIETY".
Recitals:
W I T N E S S E T H
1. The City Council has allocated $8,153.50 of Community
Development funds to be used for restoration of the Howe -Waffle House.
2. The City's FireZone regulations require that a fire
sprinkler system be installed in the Howe -Waffle House. Upon receipt
of three bids for a sprinkler system, the lowest bid of $9,176.00
from Sierra Fire Sprinkler Company was accepted by Society.
3. Society proposes to pay the difference between the
bid cost and City's contribution, as hereinafter specified.
WHEREFORE, for and in consideration of the respective
and mutual covenants and promises hereinafter contained and made,
and subject to the terms, conditions, limitations, and other
provisions of this Agreement, hereinafter set forth, the parties
do hereby agree as follows:
1. Society agrees to procure and have installed in the
Howe -Waffle House, a fire sprinkler system in conformity with the
City Fire Zone regulations.
2. City agrees to pay on behalf of Society a sum, not to
exceed $8,153.50, as hereinafter specified in paragraph 4, to be
used for the sole purpose of paying a portion of the cost of in-
stalling said sprinkler system in the Howe -Waffle House.
3. Society agrees to pay any and all expenses for said
sprinkler system in excess of said sum of $8,153.50.
4. City hereby authorizes the Executive Director of the
Community Redevelopment Agency to pay to Sierra Fire Sprinkler
Company the sum of $8,153.50 pursuant to the following payment
schedule:
(1) Two thousand, four hundred, forty five dollars
and ninety cents ($2,445.90), upon approval of
plans of said system by the Fire Chief;
(2) Two Thousand, four hundred, forty five dollars
and ninety cents ($2,445.90), upon delivery of
materials to job site for said system;
(3) Two thousand, four hundred, forty five dollars
and ninety cents ($2,445.90), upon completion of
installation of said system; and
(4) Eight hundred, fifteen dollars and fifty cents
($815.B0), upon final acceptance of said system
by the Fire Marshal of City.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written.
