Project Applicant:  Liliger Damaso with Liquor License Agents representing Bawa Kaur (business owner), on behalf of Theresia Yongwon Pak (property owner). Proposed Project: The applicant is requesting approval of Conditional Use Permit No. 2022­08 and Conditional Use Permit No. 2022­12 to allow for the upgrade of the existing ABC License from Type 20 ­ Off­Sale Beer and Wine to Type 21 ­ Off­Sale General (beer, wine, and distilled spirits). In addition, the applicant is proposing to extend the current hours of operation from 6:00 a.m. to 11:00 p.m., Sunday through Thursday and 6:00 a.m. to 12:00 a.m. on Fridays to 6:00 a.m. to 2:00 a.m. daily. EXECUTIVE SUMMARY Jeffrey Thompson, representing Live Nation Worldwide, Inc. (current operator of The Observatory), on behalf of OC Constellation, LLC (property owner) is requesting approval of Conditional Use Permit (CUP) No. 2022-10 to allow for an ancillary banquet facility use for private events, at an existing concert facility at 3503 South Harbor Blvd. Pursuant to Section 41-313.5(j) of the Santa Ana Municipal Code (SAMC), banquet facilities are permitted as an ancillary use in the Professional (P) zone, subject to development and operational standards set forth in section 41-199.1. Staff is recommending approval of the applicant’s request due to the site being used primarily as a concert/entertainment venue, the site being located away from sensitive uses and the property’s history of compliance with City codes and regulations. Conditional Use Permit No. 2022-10 was originally agendized for the June 13, 2022, Planning Commission meeting. However, at the request of staff the Planning Commission voted to continue the item. The item was first continued to the June 27, 2022, meeting, and subsequently continued to the next available regular meeting after that. Staff’s request was to allow time for discussions with the current operator regarding safety measures along the public right-of-way and the existing shared parking agreement. As a result, staff is recommending a couple of conditions of approval addressing staff concerns, which are outlined in Exhibit A of the resolution of approval. DISCUSSION Project Description The applicant is currently occupying a 25,290-square-foot commercial building and is operating as a concert/entertainment venue known as The Observatory. The applicant proposes a new CUP to allow for an ancillary banquet facility use for private events, such 7/25/2022 Planning Commission 2 –1 CUP No. 2022-10 - The Observatory July 25, 2022 Page 2 2 6 9 9 as business conferences, parties, community events, and weddings. The additional ancillary use will be invitation-only events and will not change the primary nature or operation of the venue. In addition, the proposed banquet services would require no changes to the existing venue, all improvements would be existing and no new construction is proposed. The operation of the private functions would be similar to the venue’s current operations, except that attendance would be by invitation of a private host (e.g., conferences, community events, and weddings) rather than by public ticket sales. The applicant’s employees will staff and oversee the private events. Moreover, the private events would take place during existing permitted operating hours of the venue. The current operating hours of the venue are Monday through Sunday from 7:00 a.m. to 2:00 a.m.; these hours are not proposed to change as part of the applicant’s request. Table 1: Project and Location Information Project Background The subject site currently contains two buildings, including a 48,000-square-foot medical office building and the subject 25,290-square-foot entertainment venue. The existing entertainment venue first received approval to be converted from a warehouse into a restaurant and commercial theatre for the Harlequin Dinner Theatre in 1973, with the approval of CUP No. 73-13. However, the approval was only granted for a period of 10 years and the CUP subsequently expired in 1983. In 1992, the building was remodeled to accommodate the Rhythm Café, a short-lived commercial theatre similar in operation to the Harlequin Dinner Theatre in the City of Santa Ana. The building remained vacant until 1994. At the time of the approval, the facility was proposed to operate as the Coach House. However, after receiving approval the facility began to operate as the Galaxy Concert Theatre. The venue operated as Galaxy Concert Theatre until October 2011 when the venue changed to The Observatory. In May 2019, Live Nation took over the concert operations for the location. In February 2021, CUP No. 2020- 22 was approved to allow the expansion of the sale of alcoholic beverages for on-premise consumption to an outside patio area, in conjunction with the existing concert facility. Project Analysis CUP requests are governed by Section 41-638 of the SAMC. CUPs may be granted when it can be shown that the proposed project will not adversely impact the community. If these findings can be made, then it is appropriate to grant the CUP. Conversely, the inability to make these findings would result in a denial. The purpose of regulating banquet facilities is to set forth operating practices and procedures and to minimize impacts to surrounding areas. Staff has reviewed the applicant’s request to allow for an ancillary banquet facility use for private events and has determined that the proposed CUP will not be detrimental to the health, safety, and welfare of the community. The subject site is not located within immediate proximity to parks, playgrounds, schools, or religious institutions. In addition, the building is located approximately 1,800 feet away from the nearest multi-family residences in Costa Mesa and approximately 0.5-miles (2,640 feet) from the nearest single-family residences in Santa Ana. As a result, the granting of the CUP will not negatively impact any sensitive land uses that may be nearby. The use of banquet facility/private events will allow the applicant to maximize the use of the venue and remain economically viable and competitive with similar establishments that provide private event options. In addition, the private events are intended to provide a service ancillary to the primary entertainment and restaurant use. Banquet facilities as primary or ancillary uses are subject to development and operations standards outlined in Section 41-199.1 of the SAMC. These include the facility providing: (1) full service kitchen facilities; (2) sanitation facilities in compliance with the California Building Code building standards; (3) uniformed state licensed security guard; and (4) exterior lighting in compliance with police department requirements. As an existing entertainment and restaurant use, the venue meets the above-mentioned development and operational standards. Moreover, recommended conditions of approval will ensure that uniformed security in compliance with Section 41-199.1 of the SAMC will be provided for all private events. Finally, the CUP will be consistent with several goals and policies of the General Plan. Providing a variety of full-service entertainment venues, eating establishments, and private event venues offers additional entertainment and dining options for Santa Ana residents and visitors. Furthermore, Policy LU-3.7 of the Land Use Element supports developments that create a business environment that is safe and attractive. Existing operational standards for the entertainment site (i.e., CUP No. 1994- 16 and CUP No. 2020-22) as well as property maintenance agreement will ensure a safe and attractive environment in the neighborhood. Finally, Policy LU-4.1 of the Land Use Element and EP-2.3 of the Economic Prosperity Element encourages development that is compatible with and supporting of surrounding land uses, and are mutually beneficial and complementary businesses. The Observatory is located within a professional office area and its operations (including public and private events) will be compatible with the surrounding commercial businesses. Noise Analysis Private hosts would be permitted the use of both indoor and outdoor facilities of the existing venue, including the outdoor patios. Like the concert events, all private events are subject to the City’s noise ordinance requirements in SAMC Section 18-312 and subject to cancellation or additional conditions if conducted in a manner detrimental to the health, safety, or welfare of the community. Currently, internal operations and guidelines established by the operator ensures that any ambient noise associated with the indoor entertainment is confined within the immediate site vicinity. This includes, but is not limited to, maintaining doors closed during events and preventing loitering to ensure that patrons leave in a timely manner after events have concluded. Staff is recommending a condition of approval to ensure that these measures are maintained and implemented for private events held on the site. Public Notification and Community Outreach The subject property is not located within the boundaries of an established Neighborhood Association. Project notifications were posted, published, and mailed in accordance with City and State regulations. Copies of the public notice, including a 1,000-foot notification radius map, and the site posting are provided in Exhibit 6. At the time this report was printed, no issues of concern were raised regarding the proposed CUP. ENVIRONMENTAL IMPACT Pursuant to the California Environmental Quality Act (CEQA) and the CEQA Guidelines, the project is exempt from further review pursuant to Section 15301 of the CEQA Guidelines (Class 1 - Existing Facilities). This will thereby benefit the community by providing a private banquet facility that can be rented and used. Operational standards applicable to the existing site and for ancillary banquet facilities will mitigate any potential impacts created by the use and ensure that the use will not negatively affect the surrounding community. 2. That the proposed use will not, under the circumstances of the particular case, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity. The proposed ancillary banquet use will not be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity because the operational standards applicable to the existing site and for ancillary banquet facilities will address any potential negative or adverse impacts created by the use. In addition, the subject site is not located within immediate proximity to parks, playgrounds, schools, or religious institutions and the building is located approximately 1,800 feet away from the nearest multi-family residences and approximately 0.5-miles from the nearest single-family residences. Moreover, The Observatory is intended to be an indoor concert and dinner facility and the addition of ancillary banquet use will be ancillary to the main 7/25/2022 Planning Commission 2 –7 Resolution No. 2022-XXX Page 3 of 9 use. All of the operational standards identified in SAMC Section 41-196 will apply to this establishment. 3. That the proposed use will not adversely affect the present economic stability or future economic development of properties surrounding the area. This venue has operated as an indoor concert and dinner facility at 3503 South Harbor Boulevard since 1994 under the names The Galaxy Concert Theatre and most recently under The Observatory (2011). The proposed ancillary banquet use will not adversely affect the economic stability of the area, but will instead allow the venue to maximize the use of the venue and remain economically viable and competitive with similar establishments that provide private event options. Locations for private events are generally in high demand and permitting the venue to be used for a private event space would further benefit the community. 4. That the proposed use will comply with the regulations and conditions specified in Chapter 41 of the SAMC for such use. The proposed conditional use permit will be in compliance with all applicable regulations and operational standards imposed on ancillary banquet uses pursuant to Chapter 41 of the SAMC. The facility will be maintained as a full-service, bona-fide eating establishment, having suitable kitchen facilities and supplying an assortment of foods. Additionally, the sanitation facilities are in compliance with California Building Code standards and exterior lighting in compliance with police department standards. Moreover, recommended conditions of approval will ensure that uniformed security in compliance with Section 41-199.1 of the SAMC will be provided for all private events. Lastly, operational standards will ensure the project remains in compliance with all applicable codes and regulations related to ancillary banquet uses to ensure that the use does not impact neighboring properties or create an attractive nuisance. 5. That the proposed use will not adversely affect the General Plan of the city or any specific plan applicable to the area of the proposed use. The proposed ancillary banquet use at this location will not adversely affect the General Plan or any specific plan. The granting of this CUP supports several policies contained in the General Plan. The Applicant shall indemnify, protect, defend and hold the City and/or any of its officials, officers, employees, agents, departments, agencies, authorized volunteers, and instrumentalities thereof, harmless from any and all claims, demands, lawsuits, writs of mandamus, referendum, and other proceedings (whether legal, equitable, declaratory, administrative or adjudicatory in nature), and alternative dispute resolution procedures (including, but not limited to arbitrations, mediations, and such other procedures), judgments, orders, and decisions (collectively “Actions”), brought against the City and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof, that challenge, attack, or seek to modify, set aside, void, or annul, any action of, or any permit or approval issued by the City and/or any of its officials, officers, employees, agents, departments, agencies, and instrumentalities thereof (including actions approved by the voters of the City) for or concerning the project, whether such Actions are brought under the Ralph M. The Applicant must comply in full with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The Applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. 1. The sales, service, and consumption of alcoholic beverages shall be permitted in accordance with the operational standards for on-sale establishments pursuant to Section 41-196(g) of the SAMC, in accordance with the provisions of an on- premises alcohol license by the California Department of Alcoholic Beverage Control (ABC), and in accordance with the site and floor plans attached to the staff report documenting the approved scope of the project. 2. The sales, service, and consumption of alcoholic beverages shall be limited from 8:00 a.m. and 2:00 a.m., Monday through Sunday. 3. All Conditions of Approval approved by the City of Santa Ana Planning Commission on October 17, 1994, for Conditional Use Permit No. 1994-16 and on February 22, 2021, for Conditional Use Permit No. 2020-22, shall remain in effect. 4. The shared parking arrangements required by the Conditions of Approval for Conditional Use Permit No. 1994-16 shall include the following additional conditions: (a) a requirement that Applicant conduct monthly (once per calendar month) inspections (pursuant to the inspection protocol to be demonstrated to Applicant by City Public Works Agency representatives) of the approximately 451 linear feet of street area of, and the sidewalks on the north and south side of, Lake Center Drive immediately adjacent to the concert and dinner facility at 3503 South Harbor Boulevard as shown in Attachment “A” (the “Inspection Area”) for any potential tripping or walking hazards, that may give rise to personal injuries to the Applicant’s customers when walking between the concert and dinner facility at 3503 South Harbor Boulevard and the off-site parking area designated by the effective shared parking arrangements (“Off-Site Parking”); (b) a requirement that the Applicant report within 5 days of inspection and no later than the end of the same calendar month any potential tripping or walking hazards, discovered in the Inspection Area during the inspections referenced in (a) above that may give rise to personal injuries by the Applicant’s customers walking between the concert and dinner facility at 3503 South Harbor Boulevard and the Off-Site Parking, to the City of Santa Ana by using the mySantaAna mobile app or at https://www.santa- 7/25/2022 Planning Commission 2 –11 Resolution No. 2022-XXX Page 7 of 9 ana.org/#/city/report, within five (5) days of the Applicant identifying any such conditions; and (c) a requirement that the Applicant maintain a commercial general liability policy of insurance for no less than $2,000,000 listing the City of Santa Ana as an additional insured with respect to any and all claims by Applicant’s customers alleging they suffered injury in the Inspection Area, during the one hour before The Observatory opens for business for concerts and private events and until one hour after The Observatory closes for business after such events, to the extent such injury arises from the Applicant’s failure to meet its obligations under this Condition 4. 5. Any changes to the shared parking arrangements shall require review and approval of a Minor Exemption by Zoning Administrator. The Applicant shall be responsible to obtain all necessary approvals from the City prior to utilizing any sites as part all business operations. 6. Any noise or music associated with the use of the outdoor patio shall be kept to ambient noise levels for purposes of providing a relaxed outdoor setting. At no time shall the ambient noise levels exceed the City of Santa Ana Noise Ordinance requirements. 7. Live amplified musical performances shall not be permitted within any outdoor patio areas. Musical performances are limited to acoustic music only. 8. Conditional Use Permit No. 2022-10 shall be in compliance with all required development and operational standards required for banquet facilities, as outlined in Section 41-199.1 of the SAMC. 9. All private events with or without alcohol, shall provide a uniformed state licensed security guard, as approved by the chief of police, at the rate of one (1) guard/one hundred (100) attendees, with a minimum of one (1) security guard, or other security measures as approved by the chief of police. The guards shall be present until all attendees have left the premises 10. Conditional Use Permit No. 2022-10 is subject to review by the Planning Division within one (1) year of its adoption date. Should there be a noticeable increase in the calls for Police Department and/or Code Enforcement service to the site, or complaints from the surrounding community, the City may reschedule the CUP for Planning Commission reconsideration and/or condition modification at the full expense of the property owner and Applicant. 11. Within 90 days of approval of CUP No. 2022-10, a Property Maintenance Agreement must be recorded against the property. The agreement will be subject to review and applicability by the Planning and Building Agency, the Community Development Agency, the Public Works Agency, and the City Attorney to ensure that the property and all improvements located thereupon are properly maintained, Applicant (and the owner of the property upon which the authorized use and/or authorized improvements are located if different from the Applicant) shall execute a maintenance agreement with the City of Santa Ana which shall be recorded 7/25/2022 Planning Commission 2 –12 Resolution No. 2022-XXX Page 8 of 9 against the property and which shall be in a form reasonably satisfactory to the City Attorney. The maintenance agreement shall contain covenants, conditions and restrictions relating to the following: (a) Compliance with operational conditions applicable during any period(s) of construction or major repair (e.g., proper screening and securing of the construction site; implementation of proper erosion control, dust control and noise mitigation measure; adherence to approved project phasing etc.); (b) Compliance with ongoing operational conditions, requirements and restrictions, as applicable (including but not limited to hours of operation, security requirements, the proper storage and disposal of trash and debris, enforcement of the parking management plan, and/or restrictions on certain uses); (c) Ongoing compliance with approved design and construction parameters, signage parameters and restrictions as well as landscape designs, as applicable; (d) Ongoing maintenance, repair and upkeep of the property and all improvements located thereupon (including but not limited to controls on the proliferation of trash and debris about and immediately adjacent to the property; the proper and timely removal of graffiti; the timely maintenance, repair and upkeep of damaged, vandalized and/or weathered buildings, structures and/or improvements; the timely maintenance, repair and upkeep of exterior paint, parking striping, lighting and irrigation fixtures, walls and fencing, publicly accessible bathrooms and bathroom fixtures, landscaping and related landscape improvements and the like, as applicable); (e) If Applicant and the owner of the property are different (e.g., if the Applicant is a tenant or licensee of the property or any portion thereof), both the Applicant and the owner of the property shall be signatories to the maintenance agreement and both shall be jointly and severally liable for compliance with its terms. (f) The maintenance agreement shall further provide that any party responsible for complying with its terms shall not assign its ownership interest in the property or any interest in any lease, sublease, license or sublicense, unless the prospective assignee agrees in writing to assume all of the duties, obligations and responsibilities set forth under the maintenance agreement. (g) The maintenance agreement shall contain provisions relating to the enforcement of its conditions by the City and shall also contain provisions authorizing the City to recover costs and expenses which the City may incur arising out of any enforcement and/or remediation efforts which the City may undertake in order to cure any deficiency in maintenance, repair or upkeep or to enforce any restrictions or conditions upon the use of the property. Pursuant to Section 41-196 of the Santa Ana Municipal Code (SAMC), establishments wishing to sell alcoholic beverages for on premise consumption require approval of a CUP. Staff is recommending approval of the applicant’s request because the site is located within a business park intended for such uses, the site is located away from sensitive land uses, and is in compliance with City standards. DISCUSSION Project Description Roquette Café & Bistro is a new eating establishment intending to occupy Unit 150, a 2,047-square foot suite with a 707-square foot patio, at the 201 East Sandpointe Avenue, a multi-tenant office building. The café offers French-inspired food items for breakfast, lunch, and dinner that would be available for both on-site consumption and to-go. In order to offer beer and wine to their customers, the applicant is requesting a Type 41 – On-Sale Beer & Wine. Staff has reviewed the applicant’s request to sell beer and wine under a Type 41 ABC License and has determined that the proposed CUP will not be detrimental to the health, safety, and welfare of the community. The proposed sale of beer and wine for on premise consumption is consistent with several goals and policies of the General Plan. Policy 1.1 of the General Plan Land Use Element encourages development that fosters compatibility between land uses to enhance livability. The eating establishment would be located within a suite previously occupied by similar land uses where the ABC License would not alter the nature of the business or introduce new impacts but expand the offerings of the establishment. Additionally, the proposed license would afford the business the opportunity to offer additional products to the surrounding community and encourage livability for the employees of the building and neighboring residents. Therefore, the proposed project also supports Goal 1 and 2 of the Land Use Element to provide a land use plan that improves quality of life, respects the existing community, and provides a balance of land uses that meet Santa Ana’s diverse needs. The proposed sale of beer and wine for on premise consumption will not be detrimental to the health, safety, and welfare of the community. Policy 2.6 of the Land Use Element promotes rehabilitation of properties and encourages increased levels of capital investment to create a safe and attractive environment. In line with this policy, the applicant is proposing to make onsite improvements to include new finishes, furnishings, and replacing the existing patio enclosure with a glass and wrought iron railing to open up the space. Furthermore, Policy 2.7 of the Land Use Element supports land use decisions that encourage the creation, development, and retention of business in Santa Ana. Allowing the business the ability to serve beer and wine along will allow Roquette Café & Bistro to enhance business offerings and compete with nearby full-service restaurants that offer similar services thus support the creation of the new business. Moreover, Policy 4.1 of the Land Use Element supports developments promote complete neighborhoods by encouraging a mix of complementary uses, community services, and people place within a walkable area. Approval of this CUP would promote the success of the eating establishment that would offer various goods within a walkable distance for employees or neighboring residents. The establishment will comply with the operational standards set forth in Section 41-196(g) of the SAMC, which will mitigate impacts to public health, safety, and welfare. Therefore, staff recommends approval of the proposed CUP. Police Department Analysis The Police Department reviews CUP applications for the sale and service of alcoholic beverages in order to ensure that the potential crime and nuisance behaviors associated 7/25/2022 Planning Commission 3 –3 CUP No. 2022-11 – Roquette Café & Bistro July 25, 2022 Page 4 2 8 2 0 with alcohol consumption are mitigated to the greatest extent possible. For on-sale licenses, the Police Department analyzes the crime rate in the area using the standards and definitions contained in the Business and Professions Code Section 23948.4(c)(2), which are also utilized by the State Department of Alcoholic Beverage Control. This section defines “reported crimes” as criminal homicide, forcible rape, robbery, aggravated assault, burglary, larceny theft, and motor vehicle theft, combined with all arrests for other crimes, both felonies and misdemeanors, except traffic citations. Based on our review, the Police Department has no issues of concern regarding this application. The property does not fall within the 20 percentile high crime threshold. The Police Department is satisfied that the operational standards applicable to on premise type 41 ABC license and conclude that the conditions set forth will mitigate any potential negative impact to the surrounding community and therefore does not oppose the granting of a CUP. The Police Department then compares the number of such crimes in the reporting district as compared to the number of crimes in other reporting districts. In keeping with the standard used by the State Department of Alcoholic Beverage Control and Business and Professions Code, should the Police Department determine that the reporting district has a 20 percent greater number of reported crimes than the average number found in all reporting districts, the Police Department will consider this information in making its recommendation. As part of the application process, the application was reviewed by the Police Department. Based on its review, the Police Department has no issues of concern regarding this application. Public Notification and Community Outreach The subject property is not located within the boundaries of an established Neighborhood Association. However, the contact person for the nearby Sandpointe Neighborhood Association was contacted about this project to identify any areas of concern. Project notifications were posted, published, and mailed in accordance with City and State regulations. Copies of the public notice, including a 1,000-foot notification radius map, and the site posting are provided in Exhibit 6. That the proposed use will provide a service or facility which will contribute to the general wellbeing of the neighborhood or community. The proposed sale of alcoholic beverages for on premise consumption at this location will provide an ancillary service to the eating establishment’s customers by allowing them to purchase alcoholic beverages with their meal. This will benefit the community by providing an eating establishment with an additional and complementary food related amenity. The proposed sale of alcoholic beverages for on premise consumption at this location will not be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity because the operational standards applicable to the alcoholic beverage control license and conditions of approval will address any potential negative or adverse impacts created by the use. Roquette Café & Bistro is intended to be a bona-fide restaurant and the addition of alcohol will be ancillary to the main use. All of the operational standards identified in SAMC Sec. 41-196 will apply to this establishment. Therefore, the granting of the CUP will not negatively impact any sensitive land uses that may be nearby. 3. That the proposed use will not adversely affect the present economic stability or future economic development of properties surrounding the area. The proposed use will not adversely affect the economic stability of the area, but will instead allow the eating establishment to compete with other nearby eating establishments that offer a full selection of alcoholic beverages for sale to their customers. The alcohol license for on premise sale and consumption will benefit individuals working and residing in the surrounding multi-family residential communities, and commercial uses. Moreover, offering the sale and consumption of alcoholic beverages will allow the eating establishment to remain economically viable and contribute to the overall success of the business park, thereby contributing to the overall success of the City. 4. That the proposed use will comply with the regulations and conditions specified in Chapter 41 for such use. The proposed conditional use permit will be in compliance with all applicable regulations and operational standards imposed on an eating establishment selling alcoholic beverages for on premise consumption pursuant to Chapter 41 of the SAMC. The facility will be maintained as a bona-fide eating establishment, having suitable kitchen facilities and supplying an assortment of foods. That the proposed use will not adversely affect the General Plan of the city or any specific plan applicable to the area of the proposed use. The proposed sale of alcoholic beverages for on premise consumption at this location will not adversely affect the General Plan or any specific plan. The granting of this CUP supports several goals and policies contained in the General Plan. The Applicant must comply with each and every condition listed below prior to exercising the rights conferred by this conditional use permit. The Applicant must remain in compliance with all conditions listed below throughout the life of the conditional use permit. Failure to comply with each and every condition may result in the revocation of the conditional use permit. 1. Any amendment to this conditional use permit must be submitted to the Planning Division for review. At that time, staff will determine if administrative relief is available or the conditional use permit must be amended. 2. The sale, service, and consumption of alcoholic beverages shall be permitted in accordance with the operational standards for on-sale establishments pursuant to Section 41-196(g) of the SAMC, in accordance with the provisions of an on- premise alcohol license by the California Department of Alcoholic Beverage Control (ABC), and in accordance with the site and floor plans attached to the staff report documenting the approved scope of the project. 3. The sale, service, and consumption of alcoholic beverages shall be limited from 7:00 a.m. to 12:00 a.m. (midnight) Monday through Sunday, unless modified through a subsequent and separate conditional use permit application for after- hours operations pursuant to SAMC Section 41-196(g)(3). 4. The business shall comply with all provisions of local, state or federal laws, regulations or orders, including but not limited to those of the California Department of Alcoholic Beverage Control, California Business and Profession Code Sections 24200, 24200.6, and 25612.5, as well as any condition imposed on any permits issued pursuant to applicable laws, regulations or orders. This includes compliance with the City’s business license annual renewal. 5. The premises shall not be exclusively used for private parties, including promotional events, in which the public is excluded. 6. At least one on-duty manager with authority over the activities within the facility shall be on the premises during business hours. The on-duty manager’s responsibilities shall include the monitoring of the premises to ensure compliance with all applicable State laws, Municipal Code requirements and the conditions imposed by the Department of Alcoholic Beverage Control (ABC) and the conditional use herein. Every effort shall be undertaken in managing the subject premises and the facility to discourage illegal and criminal activities and any exterior area over which the building owner exercises control. 8. Kitchen food service shall be provided during all business-operating hours. 9. Violations of the Conditional Use Permit as contained in Section 41-647.5 of the Santa Ana Municipal Code will be grounds for permit suspension and/or revocation as described in Section 41-651 of the Santa Ana Municipal Code. 10. Within 90 days of adoption of this resolution, a Property Maintenance Agreement shall be recorded against the property. The agreement will be subject to review and applicability by the Planning and Building Agency, the Community Development Agency, the Public Works Agency, and the City Attorney to ensure that the property and all improvements located thereupon are properly maintained. Applicant (and the owner of the property upon which the authorized use and/or authorized improvements are located if different from the Applicant) shall execute a maintenance agreement with the City of Santa Ana, which shall be recorded against the property and which shall be in a form reasonably satisfactory to the City Attorney. The maintenance agreement shall contain covenants, conditions and restrictions relating to the following: a) Compliance with operational conditions applicable during any period(s) of construction or major repair (e.g., proper screening and securing of the construction site; implementation of proper erosion control, dust control and noise mitigation measure; adherence to approved project phasing etc.); b) Compliance with ongoing operational conditions, requirements and restrictions, as applicable (including but not limited to hours of operation, security requirements, the proper storage and disposal of trash and debris, enforcement of the parking management plan, and/or restrictions on certain uses); c) Ongoing compliance with approved design and construction parameters, signage parameters and restrictions as well as landscape designs, as applicable; d) Ongoing maintenance, repair and upkeep of the property and all improvements located thereupon (including but not limited to controls on the proliferation of trash and debris on or about the property; the proper and timely removal of graffiti; the timely maintenance, repair and upkeep of damaged, vandalized and/or weathered buildings, structures and/or improvements; the timely maintenance, repair and upkeep of exterior paint, 7/25/2022 Planning Commission 3 –13 Resolution No. 2022-XXX Page 9 of 9 parking striping, lighting and irrigation fixtures, walls and fencing, publicly accessible bathrooms and bathroom fixtures, landscaping and related landscape improvements and the like, as applicable); e) If Applicant and the owner of the property are different (e.g., if the Applicant is a tenant or licensee of the property or any portion thereof), both the Applicant and the owner of the property shall be signatories to the maintenance agreement and both shall be jointly and severally liable for compliance with its terms; f) The maintenance agreement shall further provide that any party responsible for complying with its terms shall not assign its ownership interest in the property or any interest in any lease, sublease, license or sublicense, unless the prospective assignee agrees in writing to assume all of the duties, obligations and responsibilities set forth under the maintenance agreement; g) The maintenance agreement shall contain provisions relating to the enforcement of its conditions by the City and shall also contain provisions authorizing the City to recover costs and expenses which the City may incur arising out of any enforcement and/or remediation efforts which the City may undertake in order to cure any deficiency in maintenance, repair or upkeep or to enforce any restrictions or conditions upon the use of the property.
