(3)INSURANCE ON Ll WORK MAY PROC UNTIL INSURANC _1 \ - CITY CLERK DATE: A-2023-099 SECOND AMENDMENT TO AGREEMENT TO PROVIDE SPILL RESPONSE, HAZARDOUS WASTE DISPOSAL, AND STORM DRAIN FACILITY `n MAINTENANCE SERVICES THIS SECOND AMENDMENT to the above -referenced agreement is entered into on June 6, 2023, by and between Ocean Blue Environmental Services, Inc. ("Consultant'), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution andlawsof the State of California ("City"). RECITALS A. The parties entered into Agreement No. A-2021-097-01, dated June 15, 2021, by which Consultant agreed to provide spill response, hazardous waste disposal, and storm drain facility maintenance services ("Agreement'). The term of the Agreement is for three years with the option to extend for a one (1) two (2) year period. This Agreement remains in effect. B. The primary purpose of the Agreement is for spill response, hazardous waste disposal, and storm drain facility maintenance services. C. On October 5, 2021, the parties entered into First Amendment No. A-2021-198, by which the Agreement was amended to expand the scope of services and adjust the amount to be expended under the Agreement. The term of the First Amendment expired on June 14, 2022. D. The parties now wish to further adjust the amount to be expended under the Agreement. The Parties therefore agree: Section 2, Compensation, is amended to increase the annual amount from $350,000 to $450,000 for the remaining term of the Agreement, including the one (1) two (2) year extension option. 2. Except as modified by this Second Amendment, all terms and conditions of the Agreement shall remain in full force and effect.
