MINUTES: Acting Clerk of the Council Norma Orozco conducted Roll Call.
Councilmembers Lopez, Mendoza, Penaloza, Mayor Pro Tem Bacerra, and Mayor
Sarmiento were present in person. Councilmember Hernandez and Councilmember Phan
attended via teleconference.
PUBLIC COMMENTS — Members of the public may address the City Council on Closed
Session items.
MINUTES: No public comments were received regarding Closed Session items.
CLOSED SESSION ITEMS — The Brown Act permits legislative bodies to discuss certain
matters without members of the public present. The City Council finds, based on advice from
the City Attorney, that discussion in open session of the following matters will prejudice the
position of the City in existing and anticipated litigation:

comments received, two (2) emails from Santa Ana residents regarding non -agenda items.
Twelve (12) emails in support of Item 25, including the proposed ordinance changes. Two (2)
emails in opposition to Item 25.
Andrew Rivas spoke on non -agenda items regarding Councilmember Hernandez.
Jennifer Rojas, policy advocate and organizer with ACLU Southern California, spoke on
agenda Item 22 and on policy language and recommendations for policy changes to the
Police Oversight Commission.
Fernando Delgado spoke on Item 22 and policy changes they would like to see with the
Police Oversight Commission.
Sonny Bianchi spoke on Item 22 and police accountability, transparency, and excessive
use of force.
Hector Bustos, Communications Director with Chispa, spoke on Item 22 and

10. Award a Purchase Order in an Amount of $368,636 to Altec Industries, Inc. for Two
Utility Boom Trucks (Specification No. 22-079) (General and Non -General Fund)

Recommended Action: Authorize a one-time purchase and payment of purchase
order to Altec Industries, Inc. in the amount of $368,636, plus a contingency of

order to National Auto Fleet Group for the purchase of two Ford F-150 Trucks in the

12. Award a Purchase Order in the Amount of $104,058 to National Auto Fleet Group for

13. Approve Appropriation Adjustment to Recognize Grant Revenue, Approve an

Charitable Ventures of Orange County to Provide Bicycle Safety Education in an

of Traffic Safety (OTS) Pedestrian and Bicycle Safety grant funds in the amount of

account and appropriate the same amount to the OTS-Bicycle Safety PWA, Contract
Services -Professional expenditure account. (Requires five affirmative votes)
2. Authorize the City Manager to execute a one-year grant agreement (PS23007) with
the State of California Office of Traffic Safety for Pedestrian and Bicycle Safety
Program funds in an amount not to exceed $156,000, for a one-year period beginning
October 1, 2022 and ending September 30, 2023, (time frame consistent with the grant

BUSINESS CALENDAR
22. Discuss Draft Ordinance Establishing a Police Oversight Commission and
Provide Direction to Staff
Department(s): City Manager Office
Recommended Action: Discuss a draft ordinance establishing a police oversight
commission and provide direction to staff.
MINUTES. Senior Management Analyst Daniel Soto provided a brief presentation.
Mayor Sarmiento requested the strongest powers allowable within existing laws
and requested the next step include the ordinance for discussion and possible
approval.
Councilmember Lopez requested inclusion of some items from the community -
advocated ordinance and provided thoughts regarding specific language in the
draft ordinance.
Councilmember Hernandez concurred with Mayor Sarmiento and Councilmember
Lopez's comments and expressed concerns with the independent nature of the
proposed Commission, access to records, and powers allowed to the Commission.
Councilmember Phan addressed various components of the model ordinance
provided by the community, the multiple steps required to fully implement this
process, and how complaints would be reviewed.
Councilmember Penaloza felt it was important to move forward with the current
model before them as other changes would require a charter amendment and
addressed components of the proposed ordinance.
Mayor Pro Tem Bacerra discussed the process involved with this item and believed
the ordinance and commission would continue to grow and evolve over time after

MINUTES: City Manager Kristine Ridge reminded the Council that Judge Carter requested
the attendance of South County leaders at the hearing scheduled to take place on Friday,
October 21, 2022 at 3:00 P.M.
COUNCIL COMMENTS
AB1234 DISCLOSURE — If the City paid for travel or other expenses this is the time for members
of the Council to provide a brief oral report on attendance of any regional board or commission
meeting or any conference, meeting or event attended.
MINUTES: Councilmember Hernandez requested the meeting be adjourned in memory
of Art Lebeau.
Councilmember Lopez announced that her office is partnering with OC Habitat to host a
park cleanup and wished everyone a Happy Halloween.
Councilmember Mendoza reminded the public of the upcoming Dia De Los Muertos,
taking place on Sunday, October 23, 2022, at the Orange County Heritage Museum.
Councilmember Penaloza spoke regarding concerns raised by Delhi and Madison Park
community members related to construction on Warner Avenue and the use of City
properties for construction equipment storage.
Councilmember Phan reminded the community that the federal student loan debt relief
website is live and can be accessed via "studentaid.gov". She also announced her
participation at the UCLA Housing Symposium, in Lake Arrowhead, California. She
congratulated her sister on opening her optometrist office.
Mayor Pro Tem Bacerra thanked the community, staff, and the Santa Ana Police
Department for their presence at the community meeting regarding the flood control
channel along Flower Street, which took place at Saddleback High School. He asked for
more drive -through patrols of the trail along Bristol Street between Flower Street and
Alton Avenue. He also expressed his gratitude towards the Public Works Department for
all their work on the Bristol and Alton Bike Lane.
Mayor Sarmiento spoke regarding the potential Orange County Transportation Authority
workers' strike and its effects on Santa Ana. He requested that staff add the Anti -Cruising
Ordinance to the future items list. He wished everyone a Happy Halloween and Dia de
/os Muertos.
