TOPIC: Local Street Preventative Maintenance FY 20-21
AGENDA TITLE
Award a Construction Contract to Hardy and Harper, Inc. in the Amount of $1,532,000 for
the Local Street Preventative Maintenance FY 20-21 Project with an Estimated Project
Delivery Cost of $2,120,419 (Project No. 21-6907) (Non -General Fund)
RECOMMENDED ACTION
1. Award a construction contract to Hardy and Harper, Inc., the lowest responsible
bidder, in accordance with the base bid in the amount of $1,532,000, for construction
of the Local Street Preventative Maintenance FY 20-21, for the term beginning June
1, 2021 and ending upon project completion, and authorize the City Manager to
execute the contract subject to nonsubstantive changes approved by the City
Manager and the City Attorney.
2. Approve the Project Cost Analysis for a total estimated construction delivery cost of
$2,120,419, which includes $1,532,000 for the construction contract, $230,119 for
contract administration, inspection and testing, and a $358,300 project contingency
for unanticipated or unforeseen work.
DISCUSSION
The City's Pavement Management Program has been developed to identify the
preventive maintenance requirements for the City's street network. The local street
segments (Exhibit 1) recommended for the Fiscal Year 2020-21 Local Street Preventative
Maintenance Capital Improvement Project have been identified as high priorities for slurry
seal. The recommended work consists of preparing the roadway by performing minor
pavement repairs, including the following localized replacement of asphalt concrete
pavement, followed by slurry seal resurfacing, crack seal, striping, and signage. The
improvements also include replacement of damaged concrete curbs, gutters, sidewalks,
and curb ramps. Once completed, this project will improve the City's overall pavement
condition, enhance the visual appeal of the street, upgrade ride quality, and support
compliance with Americans with Disability Act (ADA) standards.

Public Outreach and Contractor Participation
To provide an opportunity for local vendors to submit bids, the City notified a total of
939 regional vendors via PlanetBids, many of which are Santa Ana based. Twenty-eight
vendors requested bidding documents, and a total of five bids were received. Bids were
not received from any Santa Ana contractors.
As legally required, a Notice Inviting Bids was advertised in the Orange County Register
newspaper on April 1, and 9, of 2021. The project was also advertised in PlanetBids from
March 30, 2021 through April 21, 2021. Bids were received electronically via PlanetBids
on April 21, 2021.

A total of five bids were received, and all were deemed responsive. Hardy and Harper,
Inc. submitted the lowest responsive base bid in the amount of $1,532,000 (Exhibit 2). As
specified in the bid documents, the lowest bid shall be determined on the basis of the
Base Bid. Based on the bid analysis and a contractor's reference check, staff
recommends awarding the construction contract to Hardy and Harper, Inc., in the amount
of the base bid totaling $1,532,000 (Exhibit 3).
Project Delivery
To deliver a complete project, in addition to the construction contract, the estimated total
project delivery cost includes construction administration, inspection, and testing, along
with an allowance for contingencies to account for unexpected or unforeseen conditions.
Construction administration and inspection includes construction management;
implementation of the City's Community Workforce Agreement requirements, inspection
of the Contractor's work to ensure contract compliance, workmanship, quality, and
materials testing. As indicated in the Cost Analysis (Exhibit 4) and as summarized in the
table below, the estimated total construction delivery cost of the project is $2,120,419.

ENVIRONMENTAL IMPACT
In accordance with the California Environmental Quality Act, the recommended actions
are exempt from further review. Categorical Exemption Environmental Review No. ER-
2021-38 was filed for the project.
FISCAL IMPACT
As indicated in the Cost Analysis, the estimated total construction delivery cost of the
project is $2,120,419, which includes construction, contract administration, inspection,
testing, design engineering, and an authorized contingency of $358,300.
The following table summarizes the funds budgeted for expenditure to deliver
construction of this project. All Funds are available for expenditure in Fiscal Year 2020-
21.

NOTICE INVITING BIDS
NOTICE IS HEREBY GIVEN that the City of Santa Ana will receive Bids electronically via
PlanetBids on or before 2:00 pm, April 21,.2021. No late bids will be accepted. No other
method of bid submittal will be accepted for:

Do not call Purchasing Division regarding Public Works Agency projects.
Scope of Work; includes slurry seal, cold mill; removal & replacement of asphalt concrete
pavement, curb ramp, cross gutter; repair sidewalk, curb and gutter; and signing and striping.
Pre -Bid Job Meeting: There will be no pre job walk.
Contractor's License Re uirements: From the time of City Council contract award until work
completion, the Contractor shall possess a valid California Class "A" Contractor's license. All
sub -contractors shall be properly licensed for their respective trades.
Public Works Construction Permit: The Contractor will be required to obtain a Public Works
Construction Permit (refer to Section 2-2a, Construction Permit, of these Special Provisions).
The required deposit for this permit shall be as described in the Bid Proposal.
Bid Proposal_ Guaranty:
o A scanned cop of the Bid Proposal Guaranty shall be uploaded to PlanetBids along with
project bid. Bid Proposal Guaranty shall be in the form of a cashier's or certified check
payable to the City of ,Santa Ana, or Bid Bond issued by a corporate surety, in an amount
not less than ten percent (10%) of the bid aggregate, as a guarantee that the Bidder will
enter into the proposed contract if the same is awarded. The signature of the bidder on the
bid bond must be notarized.
o In addition to electronic Bid submittals, Bidders shall deliver an original hard copy of the
Bid Proposal Guaranty. For further instructions regarding original Bid Proposal Guaranty
submittal, refer to PlanetBids.
Failure to provide required documents with Bid may cause the bid to he deemed non-
responsive.

COMMUNITY WORKFORCE AGREEMENT
For projects with bids greater than $250,000 for prime multi -trade construction contracts
(including all subcontractors) or over $100,000 for specialty contracts (contracts either limited to
a single trade or craft or limited to a singular scope of work), the CONTRACTOR shall adhere to
the CITY'S Community Workforce Agreement (CWA). This project is considered a prime
multi -trade construction contract. The CWA is a pre -hire collective bargaining agreement,
which establishes the labor relations policies and procedures for CONTRACTOR to follow in
the crafts persons employed to complete the WORK OF IMPROVEMENT as more fully
described in the CWA. The CWA is incorporated by reference in the Construction Contract. A
copy of the CWA may be found on the City's website at:

This project is subject to compliance monitoring and enforcement by the State of California
Department of Industrial Relations, per Section 1771.4.a.1. BIDDERS are required to inform
themselves fully of the conditions relating to construction and labor under which the work will
be performed. Any contract entered into pursuant to this notice will incorporate the provisions of
the California State Labor Code.
In accordance with the California State Labor Code, prevailing wage rates apply. Copies of the
prevailing rate of per diem wages are on file with the Public Works Agency and shall be made
available to any interested party on request.
A Contractor and any subcontractor must be registered with the Department of Industrial
Relations prior to submitting a bid or otherwise have the ability to be registered prior to contract
award per Section 10164 or 20103.5 of the California Business and Professions Code. "A
contractor and any subcontractor shall not be qualified to bid on, be listed in a bid proposal,
subject to the requirements of Section 4104 of the California Public Contract Code, or engage in
the performance of any contract for public work, as defined in this chapter, unless currently
registered and qualified to perform public work pursuant to Section 1725.5. It is not a violation
of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1
of the California Business and Professions Code or by Section 10164 or 201015 of the
California Public Contract Code, provided the contractor is registered to perform public work
pursuant to Section 1725.5 at the time the contract is awarded. Information about registration

A bid will not be considered nor any contract or subcontract entered into without proof of the
contractor and subcontractor's current registration to perform public work as defined in the
