AGENDA TITLE
Adopt Resolution to Maintain Measure M2 Funding Eligibility for Fiscal Year 2021-2022
RECOMMENDED ACTION
Adopt a Resolution affirming the City of Santa Ana’s Circulation Element is in
conformance with the Master Plan of Arterial Highways, and that the City has an existing
Mitigation Fee Program, to maintain Orange County Transportation Authority Measure
M2 eligibility Program funding for Fiscal Year 2021-22.
DISCUSSION
In November 1990, Orange County voters approved Measure M, a twenty-year, one-half
cent sales tax increase, to fund transportation projects in Orange County. Sixteen years
later, in November 2006, the voters again approved the Renewal of Measure M, referred
to as M2 for an additional thirty years. M2 became effective in April 2011, and the net
revenues generated by M2 contribute to two types of funding: Local Fair Share (LFS) and
Competitive funding. All Orange County cities are eligible for LFS funding which is a
formula-based allocation determined by population, the number of existing Master Plan
of Arterial Highways (MPAH) centerline miles, and taxable sales. Under the competitive
component of M2 funding, cities must compete to receive grant monies. Fulfilling M2
eligibility requirements allows the City to qualify for other regional, competitive M2 grant
funding opportunities.
The Orange County Transportation Authority (OCTA) determines annual eligibility for M2
funds based upon specific elements that cities must meet prior to June 30 of every year.
Each year local agencies are required to submit documentation to OCTA in order to
remain eligible for Measure M2 Comprehensive Transportation Funding Programs
(CTFP) funds via resolution (Exhibit 1). Additionally, every odd-numbered calendar year,
the City is required to adopt a resolution that affirms consistency between the City's
Circulation Element and the Orange County MPAH, and reaffirm that the City has an
existing mitigation fee program.
City staff has reviewed and updated the City’s street classification system to ensure traffic
mobility and traffic safety are in alignment with City goals and have coordinated those

changes with OCTA. This resolution attests that the City's adopted General Plan
Circulation Element is consistent with the MPAH, does not preclude implementation of
the MPAH within Santa Ana, and that no unilateral reduction in through lanes has been
made on MPAH arterials during FY’s 19-20 and 20-21.
In addition, the Resolution reaffirms the City's concurrence with its existing and previously
adopted Transportation System Improvement Area fees to mitigate the effects of new
development on transportation infrastructure. Measure M2 Program Guidelines require
local agencies to assess traffic impacts of new development and require new
development to pay a fair share of necessary transportation improvements attributable to
the new development. The development impact fee programs and policies currently in
place satisfy this requirement and are updated as required by Council action.
Adoption of this resolution is required to meet Measure M2 Program guidelines in order
for the City to continue to receiving Measure M2 Fairshare funds each year, and to remain
eligible for CTFP grant funding administered by OCTA. The deadline for Resolution
adoption is June 30, 2021.
ENVIRONMENTAL IMPACT
There is no environmental impact associated with the action.
FISCAL IMPACT
The recommended actions will continue the City’s eligibility to receive Measure M2 funds.
Upon meeting OCTA eligibility requirements, the City of Santa Ana is anticipated to
receive $4,708,915 million in LFS funds (as of the February 2021 estimate) and a yet to
be determined amount in M2 competitive funds for FY 2021-22. In the past, the City has
received an average of $20 million in combined annual revenue from M2 LFS and
competitive fund program allocations. If the recommended action is not approved, the
City will lose Measure M2 LFS revenue and eligibility to apply for various future OCTA
comprehensive funding programs.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
ANA CONCERNING THE STATUS AND UPDATE OF THE
CIRCULATION ELEMENT, AND MITIGATION FEE PROGRAM
FOR THE MEASURE M (M2) PROGRAM
WHEREAS, the City of Santa Ana desires to maintain and improve the streets within its
jurisdiction, including those arterials contained in the Master Plan of Arterial Highways (MPAH);
and
WHEREAS, the City of Santa Ana had endorsed a definition of and process for,
determining consistency of the City’s Traffic Circulation Plan with the MPAH; and
WHEREAS, the City has adopted a General Plan Circulation Element which does not
preclude implementation of the MPAH within its jurisdiction; and
WHEREAS, the City is required to adopt a resolution biennially informing the Orange
County Transportation Authority (OCTA) that the City’s Circulation Element is in conformance
with the MPAH and whether any changes to any arterial highways of said Circulation Element
have been adopted by the City during Fiscal Years (FY) 2019-20 and FY 2020-21; and
WHEREAS, the City is required to send biennially to the OCTA all recommended changes
to the City Circulation Element and the MPAH for the purposes of re-qualifying for participation
in the Comprehensive Transportation Funding Programs; and
WHEREAS, the City is required to adopt a resolution biennially certifying that the City has
an existing Mitigation Fee Program that assesses traffic impacts of new development and
requires new development to pay a fair share of necessary transportation improvements
attributable to the new development.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa Ana as
follows:
Section 1. The arterial highway portion of the City Circulation Element of the City is in
conformance with the MPAH.
Section 2. The City attests that no unilateral reduction in through lanes has been made
on any MPAH arterials during FY 2019-20 and FY 2020-21.
Section 3. The City affirms that it will bring forward requests to amend the MPAH, when
necessary, in order to ensure that the MPAH and the General Plan Circulation Element remain
consistent.
Section 4. The City reaffirms that the City Council concurs with the existing Mitigation
Fee Program.

Section 5. This Resolution shall take effect immediately upon its adoption by the City
Council, and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
